A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
CONFlm~ING THE SUPERINTENDENT OF
STREET'S REPORT OF THE COST OF
CONSTRUCTING CURBS AND GUTTERS ALONG
THE NORTHERLY SIDE OF CAMINO REAL
AVENUE, &lSTERLY OF EL MONTE AVENUE,
IN THE CITY OF ARCAD:r:A; FIXING THE
A:-10UNT OF THE COST OF SAID CURBS AND
GUTTERS; DECLIillING THE SMIlE TO BE
L.IENS UPON THE RESPECTIVE PARCELS OF

THE CI'I'Y COUNCIL OF THE CITY OF ARCAD:r:A, CALIFORNIA, DOES
DETERMINE AND RESOLVE AS FOLLOVIS:
SECTION 1. That pursuant to Chapter 27, Part 3, Division
7, of the Streets and Highways Code of the State of California, the
City Council of the City of Arcadia did on August 6, 1957, after a
public hearing duly held and noticed as required by law, direct the
Superintendent of Streets to proceed, in the manner prescribed in
said Streets and Highways Code, to construct or to cause to be con-
structed curbs and gutters along the northerly side of Camino Real
Avenue, easterly of El Monte Avenue in the City of Arcadia; that pur-
suant to said directive, the Superintendent of Streets constructed or
caused to be comltructed said curbs and gutters in the manner pre-
scribed by law, and on February 17, 1957, submitted to the City
Council for confirmation his itemized written report in due form
showing the costs of construction of said curbs and gutters along the
northerly side of' Camino Real Avenue, easterly of El Monte Avenue,
in the City of Arcadia, which said report itemized the costs and ex-
penses incident thereto as far as the same affects each lot and parcel
of land fronting along said street.
SECTION 2. That on February 2l, 1958, the City Council
ordered that a public hearing be held and noticed for March 4, 1958,

for the purpose of hearing protests and objections to said report of
costs and proposed assessments; and that said hearing was duly noticed
and held on said date and at said time and place.
SECTION 3. That at the time and place fixed for hearing pro-
tests and objections to said report, to wit, in the Council Chambers
of the City of Arcadia at 8:00 o'clock p.m. on March 4, 1958, all pro-
tests and objections were duly presented, read, heard and considered
and all persons desiring to be heard thereon were heard, and all other
persons appearing at said hearing and desiring to be heard in the matter
of said costs and assessments were heard.
SECTION 4. The said Arcadia City Council, being fUlly advised
in the premises, did then and there further consider the protest of the
Los Angeles County ~lood Control District to the proposed assessment of
costs in the amount of $194.20, representing cost of construction of
93 feet of curbs and gutters along Parcel 2, legal title to which is
held by said Los Angeles County Flood Control District, and it was
determined that said protest be upheld with respect to 35.03 feet of
curbs and gutters abutting the operating portion of the Los Angeles
County Flood Control right of way, assessed in the amount of Seventy-
three and 15/100 Dollars (~73.15), but should be overruled with respect
to 57.97 feet of curbs and gutters abutting the nonoperating prop-
erties of the said Los Angeles County Flood Control District assessed
in the amount of One hundred twenty-one and 5/100 Dollars ($121.05);
and that the Report of the Superintendent of Streets should be modi-
fied to show total cost and assessment against said Parcel 2 to be
One hundred twenty-one and 05/100 dollars ($121.05) for 57.97 feet of
curbs and gutters, rather than 93 feet, at a total cost of One hundred
ninety-four and 20/100 Dollars ($194.20) as reported. That said re-
port should further be modified to show the City of Arcadia to be
assessed the costs for 35.Q3 feet of curbs and gutters in a total
amount of Seventy-three and 15/100 Dollars ($73.15).

SECTION 5. That after modifying the report as provided
herein the City Council continued the hearing until March 18, 1958>
at the same time and place, for further consideration of the modi-
fied report.
SECTION 6. That at said time and place, to wit, in the
Council Chambers of the City of Arcadia, at 8:00 o'clock p.m. on
March 18, 1958, all protests and objections to the report as thus
modified were duly presented, read, heard and considered and all per-
sons desiring to be heard thereon were heard and all other persons
appearing at said hearing and desiring to be heard in the matter of
said costs and assessments were heard and all protests and objections
to the said modified report made by the SUperintendent of streets as
to the cost of constructing curbs and gutters along the northerly
side of Camino Real Avenue, easterly of EI Monte Avenue in the City
of Arcadia, except as otherwise herein above specified, are hereby
denied and overruled, and all protests and objections in the matter,
either as to the original written report of the Superintendent of
Streets or to the aforesaid modified report of the Superintendent of
Streets, are hereby denied and overruled except as hereinbefore speci-
fically allowed or sustained.
SECTION 7. That pursuant to the aforesaid Streets and High-
ways Code, the Street Superintendent's itemized written report, modi-
fied as hereinbefore specified, showing the cost of construction of
curbs and gutters along the northerly side of Camino Real Avenue,
easterly of El Monte Avenue in the City of Arcadia, as the same af-
fects each lot a:~d parcal of land, is hereby confirmed in all particu-
lars, and the amounts of the costs and expenses for said construction
of curbs and gutters, as the same affects each such parcel and lot,
are hereby adjudged to have been necessary and are in each case reason-
able in amount, and such costs and expenses are hereby declared, as
provided by law, to be liens on each respective lot and parcal of land,
in the respective amounts as the same appear on said modified report

of the Superinter,.dent of Streets.
SECTION 8. That the following attached list, incorporated
herein by reference, is the list and description of each such lot and
parcel of land in the City of Arcadia, with the several amounts due
respectively from each of such lots or parcels of lands for such con-
struction of curbs and gutters and upon which liens are now declared
as above stated, and all protests and objections, oral and written,
other than as herein affirmed, having been overruled and denied by
the City Council, the City Clerk is hereby directed, thirty-one (31)
days from the date hereof, to send a copy of this resolution, duly
certified, to the County Auditor of the County of Los Angeles, State
of California, together with Notice of Lien, executed by the Super-
intendent of streets with respect to all assessments which shall not
have been paid on the 31st day after date hereof, along with a report
indicating which of said liens have been discharged since the date of
this confirmation, for inclusion with and collection together with
all other taxes and assessments to be collected by the County of Los
Angeles for and on behalf of the City of Arcadia.
SECTION 9. The City Clerk is further directed to forward
to said County Auditor a certified copy of Resolution No. 2992 of the
City Council of the City of Arcadia, whereby said City Council author-
ized payment of said assessments in five annual installments as pro-
vided in the aforesaid streets and Highways Code.
SECTION 10. The City Clerk shall certify to the adoption
of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia held
on the 18th day of March , 1958, by the affirmative vote of at
least three Councilmen, to wit:
