HomeMy WebLinkAbout2822 , . ~ RESOLUTION NO. 2822 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING AN APPLICATION FOR RECLASSIFICATION OF CERTAIN PROPERTY ON SOUTH SECOND AVENUE AND ON DUARTE ROAD. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission of ~he City of Arcadia on the 28th day of June, 1956, the application of Fred M. Coxon and others, as owners, for a zone reclassification from Zones R-l, R-2 and C-l to Zones C-2 and P of the following described real property in the State of California, County of Los Angeles, to wit: Lot 9, and the west half of Lot 10, Block 62, Santa Anita Tract, as shown on map recorded in Book 16, page 58, Miscellaneous Records of Los Angeles County; and the East 104.96 feet of Lot 13j the West 113.28 feet of Lot 14; and Lot 33, except the South 80 feet of the West 120.46 feet thereof, Tract No. 808, as shown on map recorded in Book 16, pages 82 and 83, of Maps, in the office of said Los Angeles County Recorder, which is located at 902 South Second Avenue and 125, 134, 140 and 208 East Duarte Road. That after notice as required by law, a pub- lic hearing on the matter was held by and before said City Planning Commission on the 24th day of July, 1956, which hearing was duly con- tinued to August 14, 1956, at which times all interested persons were given a full opportunity to be heard and to present evidence. That thereupon said Commission on August 28, 1956, adopted ~ cer- tain Resolution No. 228, wherein and whereby it made certain find- ings and recommendations to this Council. SECTION 2. That after notice as required by law, a public hearing on the matter was held by and before this City Council on the 16th day of October, 1956, at which time all interested persons -1- 2822 ~------ . r::(" . " . were given a full opportunity to be heard and to present evidence. SECTION 3. That the City Council has fully reviewed the files in the matter and fully considered all evidence presented. That in addition to over eighty written protests filed with and many oral protests made to the Planning Commission, written protests signed by over 140 individual residents in the neighborhood and from the Home Owners Association of Southern Arcadia were filed with the City ~ouncil; that there were oral protests from a repre- sentative of t~e Arcadia Presbyterian Church nearby, from an attor- ney representi~g residents on Greenfield and Magna Vista and from residents themselves. That in addition to those speaking in favor of the proposed zone change, there were written petitions with several hundred signatures in favor of the change, but that many of those signing such petitions were neither residents of the City of Arcadia nor owners of property which might be affected thereby. That neither the public necessity, convenience nor general welfare requires or justifies the requested change of zone at this time. SECTION 4. That much of the subject property has been reclassified to Zone C-l within the last year; that there has been no commercial development of the property since such rezoning; that sufficient time has not elapsed to show the need of a different zoning; that there is still much vacant C-2 and C-3 property in the City of Arcadia available for such commercial development that should be used before more property is changed to general commercial use. That the rezoning of subject property comprising separate par- cels in three different blocks on Duarte Road would constitute spot zoning; that any rezoning of Duarte Road property should consider the street as a. whole and not individual parcels. That many of the uses presently allowed in Zone C-2 would be objectionable to the nearby residents. SECTION~. That for each of the foregoing reasons, the -2- 2822 . . . . . application of Fred r,l. Coxon and others for a zone reclassification from Zones R-l, R-2 and C-l to Zones C-2 and P of the above described property should be and the same is hereby denied. That this Coun- cil's determi~ation is based upon each of the foregoing facts and reasons and its decision would remain the same even if anyone or more, but less than all of the foregoin3 facts or anyone or more, but less than all of the reasons were removed. SECTION 6. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 8th day of November , 1956, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Jacobi, Dennis, Phillips, Reibold and Camphouse NOES: None ABSENT: None ~,;:.~~ SIG~ED AND APPROVED this 8th , 1956.
