RESOLUTION NO. 2824
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
SPECIFYING REQUIRE~lliNTS AND CONDITIONS
FOR THE REPLACEMENT OF CERTAIN STREET
EXCAVATIONS BY THE LOS ANGELES COUNTY
FLOOD CONTROL DISTRICT.
WHEREAS, the Los Angeles County Flood Control District is
constructing a storm drain known as Storm Drain Project No. 24,
Michillinda Avenue Drain, hereinafter referred to as "PROJECT", in
accordance with plans and specifications approved in Resolution No.
2752 of the City of Arcadia, dated Narch 6, 1956; and,
WHEREAS, construction of this project provides for the re-
placement of existing pavement within the trench limits in Sunset
Boulevard southerly of Huntington Boulevard to Duarte Road, and in
Duarte Road from Sunset Boulevard to the westerly city boundary of
Arcadia with 7~ inches of asphaltic concrete, and in Sunset Boule-
vard between the north side of Huntington Drive and the intersection
of r.lichillinda Avenue and Sunset Boulevard with four inches of
asphaltic concrete; and,
WHEREAS, said City of Arcadia has found it desirable to
have the paving in Sunset Boulevard between the southerly line of
Huntington Boulevard and Duarte Road, and in Duarte Road from Sunset
Boulevard to the westerly city boundary replaced as follows:
A. Five inches of premix (in accordance with Los Angeles
County Road Department Specifications) within the trench width
of the project;
B. A tack coat (in accordance with Los Angeles County Road
Department Specifications) over the existing pavement between
the curb lines;
C. A one-inch top coat of premix over the entire street
width between the curb lines, including the trench width;
D. An oil seal coat of 1/10 gallon per square yard (Class
"D", in accordance with the State Standard Specifications);

and the paving in Sunset Boulevard between the north side of Hunt-
ington Drive and the intersection of Sunset Boulevard and Michil-
linda Avenue replaced as follows:
A. Two and one-half inches of premix (in accordance with
Los Angeles County Road Department Specifications) within the
trench width of the project;
B. A tack coat (in accordance with Los Angeles County
Road Department Specifications) over the existing pavement
between the curb lines;
C. A one-inch premix top coat over the entire street
width between curb lines including the trench width;
D. An oil seal coat of 1/10 gallon per square yard
(Class "D", in accordance with State Standard Specifications);
and,
vffiEREAS, City is willing to accept the streets repaved in
the manner as set forth as meeting all of LoS Angeles County Flood Con-
trol District's obligations to restore said streets to their former
state of usefulness, to hold said District free and harmless of any
and all liability for failure to fulfill its obligations under Sec-
tion 15 of the Los Angeles County Flood Control Act, and to pay to
District any and all costs or obligations incurred by District in ful-
fillment of said obligations.
NOW, THEREFORE, THE CITY COUNCIL OF ARCADIA DOES FIND,
DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That Los Angeles County Flood Control District
is hereby requested to repave Sunset Boulevard between the southerly
line of Huntington Boulevard and Duarte Road, and in Duarte Road
from Sunset Boulevard to the westerly City boundary replaced as fol-
lows:
A. Five inches of premix (in accordance with Los An6eles
County Road Department Specifications) within the trench width
of the project;

Road Department Specifications) over the existing pavement
between the curb lines;
C. A one-inch top coat of premix over the entire street
width between the curb lines, including the trench width;
D. An oil seal coat of 1/10 gallon per square yard
(Class "D", in accordance with the State Standard Specifica-
tions);
and the paving in Sunset Boulevard between the north side of Hunting-
ton Drive and the intersection of Sunset Boulevard and and Michil-
linda Avenue replaced as follows:
A. Two and one-half inches of premix (in accordance with
Los Angeles County Road Department Specifications) within the
trench w:ldth of the project;
B. A tack coat (in accordance with Los Angeles County
Road Department Specifications) over the existing pavement be-
tween the curb lines;
C. A one-inch premix top coat over the entire street width
between curb lines including the trench width;
D. An oil seal coat of 1/10 gallon per square yard (Class
"D", in accordance with State Standard Specifications).
SECTION 2. To accept the requested paving over the trench
limits of said project and the paving between the curb lines of the
afore-mentioned streets and trench limits as filling District's ob-
ligations to restore said streets to their former state of useful-
ness.
SECTION 3. To indemnify and hold harmless the Los Angeles
County Flood 8ontrol District, its officers, agents and employees
from any and all liability for failure to fulfill its obligations
under Section 15 of the Los Angeles County Flood Control Act (Volume
I, Water Code, Uncodified Act 4453, Section 15) and to pay to District
any and all costs or obligations incurred by District in fulfillment
of said obligations.

SEC~ION 4. It is understood that the thickness of paving
to be placed as indicated above is nominal only and may be varied to
meet conditions or improvements as they now exist.
SEC~ION 5. The City Clerk shall certify to the adoption
of this Resolution and shall cause a certified copy tbereof to be
forwarded to the Los Angeles County Flood Control District.
I m~REBY CERTIFY that the foregoing Resolution was adopted
at a resular meeting of the City Council of the City of Arcadia held
on the 7th day of November, 1956, by the affirmative vote of at
least three Councilmen, to wit:
AYES: Councilmen Jacobi, Phillips, Reibold and Camphouse
NOES: None
ABSENT: Councilman Dennis
