HomeMy WebLinkAbout2829 " 2" RESOLUTION NO. 2829 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, SETTING A HEARING FOR THE PURPOSE OF DETERMINING WHETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IMPROVEMENT OF THE FIRST ALLEY SOUTH OF LAUREL AVENUE BETWEEN SECOND AVENUE AND WIGWAM AVENUE, ALL WITHIN THE CITY OF ARCADIA, CALIFORNIA. WHEREAS, Section 17 of Article XIII of the Constitution of the State of California provides that the debt limitation and majority pro- test proviSions of said section shall not apply if, after the giving of such reasonable notice by publication and posting and the holding of such public hearing as the City Council of the City of Arcadia shall have prescribed, said council by no less than a 4/5ths vote of all members thereof, finds and determines that the public convenience and necessity require the improvement proposed to be made; and WHEREAS, Section 2804 of the Streets and Highways Code of the State of California provides that the IISpecial Assessment Investigation, Limitation and Majority Protest Act of 1931" shall not apply to any pro- ceeding otherwise subject thereto when said improvement proceeding is by a charter city and said city has complied with the provisions of Section 17 of Article XIII of the Constitution of the state of California; and WHEREAS, the City of Arcadia is a charter city of the state of California. NOW, THEREFORE, THE CITY OOUNCIL OF THE CITY OF ARCADIA, CALIFORNIA DOES RESOLVE AS FOLLOWS: SECTION 1, That said City Council proposes to initiate proceed- ings for the improvement of the first alley south of Laurel Avenue between Second Aven~e and Wigwam Avenue, all within the City of Arcadia, by the grading, preparing subgrade, paving and construction of concrete curbs, gutters and aprons and appurtenant work thereto. The nature, location, and extent of the proposed improvement and the district to be assessed for the cost and expenses thereof are as shown respectively on the plan and profile No, 231, adopted by the City Council of the City of Arcadia, by = . (:;.I' . . . --'.a Resolution No, 2827 on December 4, 1956 , and assessment dis- trict map No, w-68, adopted on December 4, 1956 by said City Council by Resolution No. 2828' \, , and on file in the office of the City Engineer and the office of the City Clerk of said city and in accordance with specification entitled "Specifications and Contract Documents for Improve- ment of Alley South of Laurel Avenue from Second l\:'(r,enue West, Job No, 231" which said specification duly was adopted by said City Council by , Resolution No. 2827 on the 4th day of December ,1956, which said plan and profile, assessment district map and specification now are on file in the office of the City Engineer and of the City Clerk of said city, to which said plan and profile, assessment district map and speci- fication reference is made for all particulars relative thereto. SECTION 2, That the total estimated cost of the proposed improvement is $3854.94, SECTION 3, That the said improvement shall be conducted under the Improvement Act of 1911, which is Division 7 of the Streets and Highways Code of the State of California, SECTION 4, That notice hereby is given that on the 18th day of December , 1956, at 8:00 o'dlockP.M., in the Council Chamber located in the City Hall of said city, there shall be a public hearing before said City Council for the purpose of determining whether the public convenience and necessity require the above described improvement, SECTION 5. That the City Clerk shall give notice of the hearing by posting a copy of this resolution in the manner prescribed by Section 5065 of the streets and Highways Code and by publication as hereinafter provided. Any person interested may make protest against the proposed improvemer'ltih"writihg' filed with the City Clerk at.'any--time. not l-ater than the hour set for the hearing in the manner provided by Section 5220 of the Streets and Highways Code, SECTION 6. That the City Clerk hereby, is directed to publish ,and Arcadia News this Resolution in the Arcadia Tribune/t on two successive dates, the " first publication to be made not less than ten (10) days prior to the date of the above public hearing. SECTION 7. The City Clerk shall certify to the adoptfion of this resolution and thenceforth and thereafter the same shall be in full force and effect.
