RESOLUTION NO. 2835
RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
DETERMINING THAT THE PUBLIC INTER-
EST, CONVENIENCE AND NECESSITY
REQUIRE THE FORMATION OF VEHICLE
PARKING DISTRICT NO. 2 OF SAID CITY
AND REQUIRE THE ACQUISITION AND
IMPROVEMENT SUBSTANTIALLY AS SET
FORTH IN THE REPORT ON FILE, AND
DETERMINING THE PROJECT FEASIBLE.
(Vehicle Parking District No.2)
WHEREAS, a petition under the Vehicle Parking
District Law of 1943 (Part 1 of Division 18 of the Streets
and Highways Code of the State of California) for the
creation of a vehicle parking district, was filed in the
office of the Clerk~f this City Council on July 3, 1956,
and said petition was duly signed by the requisite number
of qualified signers; and
WHEREAS, this City Council, by Resolution No. 2791,
~rdered a report under the Special Assessment Investigation,
Limitation and Majority Protest Act of 1931, on the acqui-
sition and improvement proposed in said petition; and
WHEREAS, said report was dUly filed and by Resolu-
tion No. 28~. this City Council approved said report and
fixed a time and place of hearing thereon; and
WHEREAS, notice of said hearing was mailed as
required by said Investigation Act; and
WHEREAS, said hearing was held at the time and place
so fixed, and said hearing was duly concluded; and
WHEREAS, all oral and written protests, if any,
have been duly heard and all persons desiring to be heard
on the said report or upon the proposed project have been
heard;
NOW, THEREFORE, the City Council of the City of
Arcadia,California, DOES HEREBY RESOLVE, DETERMINE AND
ORDER as follows:
Section 1. That said report contains all the matters
$nd things required by law and that notice of hearing on
the proposed project generally described therein has been
uuly and regularly given.
Section 2. That no protest has been made by the
owners of one-half of the area of the property to be assessed
for the proposed acquisition and improvement, and that there
is no majority protest against only a portion of the proposed
improvement or acquisition.
Section 3. That any and all protests and obJections,
if any, filed in writing or made orally in the said matter,
be and the same are hereby overruled and denied.
Section 4. That the public interest, convenience
and necessity require the acquisition and improvement sub-
stantially as set forth in the report and that the project
is feasible; that the lands to be assessed for said work
will be able to carry the burden of the proposed assessment
for said work and that, pursuant to Section 2905 of the Streets
and Highways Code, the limitations as set forth in said
Special Assessment Investigation, Limitation and Majority
Protest Act of 1931 shall be disregarded both with respect

to the proposed assessment district as a whole and as to
the limitation on individual specific assessments for said
work; and that this City Council determines to proceed
under said Vehicle Parking Law of 1943 to form Vehicle
Parking District No. 2 of the City of Arcadia, and to make
the acquisi't;ion and improvement substantially as set forth
in said report on file and described in said petition on file.

resolution was duly adopted by the City Council of said city
by a vote of 4/5ths of the members thereof and was approved
by the Mayor of said city at a regular meet-
ing of the City Council of saio-city held on the 4th day
of December, 1956, and that it was so adopted by the following
