HomeMy WebLinkAbout2859 , RESOLUTION NO. 2859 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA. CALIFORNIA, DETERMINING THAT CITY-OWNED PREMISES UNDER LEASE ARE REQUIRED FOR PUBLIC PURPOSES. WHEREAS. on May 20. 1953, the City of Arcadia entered into an agreement of lease with the Arcadia American Little League and the Arcadia National Little League, wherein and whereby the City of Arcadia leased unto said Leagues certain city-owned real property adjacent to the City Hall, for the use of said Leagues for the playing of baseball games and practicing for the same, and for related usesj and, WHEREAS, said lease was, in August of 1954, amended to include additional adjacent city-owned property not included in said original lease of May 20. 1953j and, WHEREAS, on January 15, 1957, the City Council of the City of Arcadia approved plans for the development of the civic center site, which plans necessarily include the use for public purposes of the properties described and included in aforesaid lease dated May 20, 1953, and as amended in August of 1954j and, WHEREAS, aforesaid lease dated May 20, 1953, and as amended in August of 1954, provides in part that the lease shall continue from calendar year to calendar year until such time as the City, through its duly elected officers, dete~nines by resolu- tion that the premises are needed by the City for other public pur- poses, and that the lease may be cancelled by the City at the close of any calendar year, provided that City shall give the City's Leagues at least six calendar months' notice in writing of such can- cellation. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That the following described premises, to wit: -1- 2859 That portion of Lot 5, of Tract No. 949, in the City of Arcadia, County of Los Angeles, state of California, as per map recorded in Book 17, page 11 of Maps, in the office of the Recorder of said County, described as follows: Beginning at a point in the southeasterly line of said Lot 5 distant thereon South 38033'00" West 835.51 feet from the most easterly corner of said Lot 5; said point also being the most southerly corner of the land conveyed to Baldwin M. Baldwin by Parcel "A" of the deed recorded Decem- ber 17, 1934 as Instrument No. 136 in Book 13108, page 318, of Official Records; thence along said southeasterly line South 38033'00" West 250 feet; thence Nor.th 5i021'00" West 250 feet; thence South 38033'00" West 65 feet; thence North 51027'00" West 257.11 feet; thence North 38033'00" East 315 feet; thence South 51027'00" East 507.11 feet to the point of beginning, are needed by the City of Arcadia for public purposes, to wit: the development of the Arcadia civic center including the con- struction of roadways, parking places, curbs, walks and planting area, in accordance with the plane heretofore approved by the City Council of the City of Arcadia on January 15, 1957. That the premi- ses hereinabove described are included in the lease dated May 20, 1953, as amended in August of 1954, by and between the City of Arcadia and the Arcadia American Little League and the Arcadia National Little League. That the required publiC use of aforesaid premises necessitates the cancellation of the lease of said premi- ses at the earliest lawful date. SECTION 2. That that said lease dated May 20, 1953, as amended in August of 1954, by and between the City of Arcadia and the Arcadia American Little League and the Arcadia National Little League, covering the premises described above, is hereby terminated, in accordance with aforesaid lease, said termination to be effec- tive as of December 31, 1957. SECTION 3. The City Clerk shall certify to the adoption of this Resolution and shall cause a copy hereof to be delivered to the Arcadia American Little League and the Arcadia National Little League.
