HomeMy WebLinkAbout2889 RE30LUTION NO. 2889 A aESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, HAKIi':G CERTAIN FINDINGS AND DETEm~INATIONS CONCERNING THE RECLASSIFICATION OF REAL PROPERTY IN SAID CITY. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE AND RESOLVE AS FOLLO\'!3: SECTION 1. That after proceedings duly instituted and public hearings duly and regularly held by and before the City Plan- ning Commission and the City Council of the City of Arcadia after due notice as ~equired by law, the City Council hereby determines that the real properties hereinafter described should be respec- tively reclassified as hereinafter provided, upon compliance with and performance of the following conditions: a. ~hat the following real property be dedicated for the uniform widening of Baldwin Avenue: The Easterl~ thirteen (13) feet of the westerly fifteen (15) feet, measured at right angles to the westerly line of Lot 39, Tract No. 3430, per map recorded in Book 42, page 32, of Haps in the office of the County Recorder of Los Angeles CountYj and The Easterl~ fifteen (15) the westerly cel: That portion of Lot 40, Tract No. 3430, per map recorded in Book 42, page 32, of Maps, in the office of the County Recorder of Los Angeles County, described as follows: thirteen (13) feet of the westerly feet, measured at right angles to line of the following described par- Commencing at the northwest corner of said lotj thence easterly along the north line thereof, 215.52 feetj thence southerly parallel with the east line of said lot, 63 feet to a pointj thence westerly in a direct line to a point in the westerly line thereof, distant southerly from the northwest corner thereof, 50 feet; thence northerly along t;le said westerly line 50 feet to the point of be,3inningj b. Tiat the wood frame apcessory building, located on Lot 39, Tract No. 3430, at the rear of the adjacent new clinic building be removedj -1- 2889 c. That the existing dwelling recently relocated at the rear of the property may be used for dwelling purposes but may not be used for ccmmercial purposes without a variance therefor; d. That that portion of the property which is rezoned to Zone C-2 shall automatically be placed in Fire Zone No.1. That such reclassification of said properties would not be proper without the performance of and the compliance with said conditions and that the said conditions are necessitated by and are a prerequisite to the proper reclassification of said properties. SECTION 2. That the following described property in the City of Arcadia, County of Los Angeles, state of California, to wit: The East 115 feet of that part of Lot 39, Tract No. 3430, as sho\qn on map recorded in Book 42, page 32, of Maps, records of Los Angeles County, commencing at the northwest corner of Lot 39; thence South 3043' West 100.89 feet; thence North 86010'10" East 215.48 feet; thence South 3043' i'lest 40 feet; thence North 85010'10" East 150.34 feet; thence North 139.98 feet; thence South 87010'10" Hest 356.66 feet to beginning, should be reclassified as a district in Zone PR-2 under the provi- sions of Ordinance No. 760 of said City, and the following described property in the City of Arcadia, County of Los Angeles, State of California, to wit: Part of Lot 39, Tract No. 3430, as shown on map recorded in Book 42, page 32, of !1aps, records of Los Angeles County, commencing at the northwest corner of Lot 39; thence South 3043' West 100.89 feet; thence North 86010'10" East 215.48 feet; thence South 3043' \-Jest 40 feet; thence North 86010'10" East 150.34 feet; thence North 139.98 feet; tilence Sout:l 86010'10" i'lest 356.66 feet to beginning, except the Vest 150 feet thereof, and except the East 115 feet thereof; and Part of Lots 39 and 40 of said Tract No. 3430, commencing South 3043' Hest 100.89 feet from the northwest corner of Lot 39; thence South 3043' Hest 90 feet; thence North 89039'35" East 218.25 feet; thence North 63 feet; thence North 3043' East 40 feet; thence South 87010'10" Hest 215.48 feet to beginning, except the West 150 feet thereof, should be reclaSsified as and established as a district in Zone C-2 under the provisions of Ordinance No. 760 of said City, upon the -2- 2889 compliance with and performance of the conditions hereinabove set forth. SECTION 3. That upon the performance of and the com- pliance with the aforesaid conditions, the foregoing properties shall without further proceedings or hearings be reclassified re- spectively as hereinabove set forth. SECTION 4. The City Clerk shall certify to the adoption of this Hesolu1;1on. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 2J,st day of I'lay , 1957, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Jacobi, Camphouse, Phillips, Reibold and Dennis .~.
