HomeMy WebLinkAbout2724 RESOLUTION NO. 2724 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DE- CLARING ITS INTENTION TO FORM A LIGHTING MAINTENANCE DISTRICT, WHICH DISTRICT IS TO PAY THE COST AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGH'l! NG SYSTEM ON PORTIONS OF ANITA CREST DRIVE, EIGHTH AVENUE, HUNGATE LANE, BELLA VISTA DRIVE, MAGNOLIA LANE, WILSON AVENUE, ELKINS PLACE, HIGHLAND OAKS PLACE, SIERRA MADRE BOULEVARD, ELEVADO AVENUE, GRANDVIEW AVENUE, LONGDEN AVENUE, SOUTH- VIEW ROAD, TENTH AVENUE, LOGANRITA AVENUE, CAROLWOOD DRIVE, HIGHLAND OAKS DRIVE, DOOLITTLE AVENUE, VIRGINIA DRIVE, COYLE AVENUE, PEACHTREE LANE, vlISTJl;RIA AVENUE, BUNGALOW PLACE, MAYFLOWER AVENUE, CANYON ROAD, VISTA AVENUE AND DOSHIER AVENUE IN SAID CITY, AND FIXING A TI!1E AND PLACE FOR HEARING OBJECTIONS TO THE FORMATION OF SAID DISTRICT OR TO THE EXTENT THEREOF. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience re- quire and it is the intention of the City Council of the City of Arcadia to form a lighting maintenance district to be known as Lighting Maintenance District No. 10, for the purpose of assessing said district to pay a portion of the cost and expenses of maintain- ing and operating a street lighting system consisting of sixty-seven (67) 2500 lumen lamps on portions of Anita Crest Drive, Eighth Avenue, Hungate Lane, Bella Vista Drive, Magnolia Lane, Wilson Avenue, Elkins Place, Highland Oaks Place, Sierra Madre Boulevard, Elevado Avenue, Grandview Avenue, Longden Avenue, Southview Road, Tenth Avenue, Loganrita Avenue, Carolwood Drive, Highland Oaks Drive, Doolittle Avenue, Virginia Drive, Coyle Avenue, Peachtree Lane, Wistaria Avenue, Bungalow Place, Mayflower Avenue, Canyon Road, Vista Avenue and Doshier Avenue. SECTION 2. The items of expense of maintenance and opera- tion of the said lighting system to be furnished and to be assessed in part against the lands within the district (exclusive of -1- .;..;;-;'. , 2724 improvements), are electric power, repairs, replacements, maintenance, labor, materials, engineering, printing and advertising. Theesti- mated amount of electric power necessary for said system for each year is forty-one thousand four hundred sixty-nine (41,469) kilowatt hours and the estimated cost of said electric power for the first year of maintenance and operation is the sum of seven hundred fifty dollars ($750.00). SECTION 3. That the said contemplated maintenance and operation of said lighting system in the opinion of the City Council of the City of Arcadia is of more than local or ordinary' public bene- fit and said City Council hereby makes the expense of said mainte- nance and operation. exclusive of the amount to be paid by said City as stated in Section 5 hereof, chargeable upon a district, which district said City Council hereby declares to be the district bene- fited by said maintenance and operation and to be assessed to pay the cost and expense thereof; which said district shall, in general. include all those lots fronting on said portions of said streets. A plat or map~ said District, indicating by a boundary line the extent of the lands included in the proposed district. and indicating by symbol showing the type of lighting1was approved and adopted by the City Council of said City of Arcadia, and is on file in the office of the City Clerk of the City of Arcadia. Reference is hereby made to said plat or map for further, full and complete description of said Lighting Maintenance District No. 10, and said map so on file shall govern for all details as to the extent of such district. SECTION 4. That said maintenance and operation shall be furnished for said system for a period from the date of the forma- tion of said district to and including June 30, 1958. SECTION 5. The City Council of the City of Arcadia hereby orders that fifty percent (50%) of the total maintenance and opera- tion cost and e;cpenses of said system be paid out of the treasury of -2- . ~ 2724 said city from the general fund of said city. SECTION 6. Notice is hereby given that on Tuesday, the 17th day of January, 1956, at the hour of 8:00 o'clock p.m. of said day, in the Council Chambers of said City Council of said City of Arcadia. in the City Hall of said City, any and all persons owning land or having any interest in lands within the district li- able to be assessed for the expenses of said maintenance and opera- tion or any portion thereof. may be heard and any of said persons may present any objections that they may have by protest. SECTION 7. All the proceedings for the aforesaid mainte- nance and operation ,of said system shall be had and taken under and in accordance with the provisions of an act of the Legislature of the state of California. known and designated as the Municipal Lighting Maintenance District Act of 1927, being Division 14, Part 3 of the Streets and Highways Code of the state of California. SECTION 8. The Superintendent of Streets shall post or cause to be posted, copies of this Resolution headed "Notice of formation of lighting maintenance district" along all open streets within said district liable to be assessed, in the manner and form required by law. SECTION 9. The City Clerk shall certify to the adoption of this Resolution and shall cause the same to be published twice in the Arcadia Bulletin, a newspaper of general circulation published and circulated in the City of Arcadia and hereby designated for that purpose. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 20th day of December. 1955, by the affirmative vote of at least three Councilmen, to wit: -3- 2724 AYES: Councilmen Camphouse.
