RESOLUTION NO. 2742
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
DENYING AN APPLICATION FOR A VARIANCE
TO PERMIT TIRE REPAIR AND RECAPPING
IN A COMMERCIAL ZONE.
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA.
DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That there was filed with the City Planning
Commission of the City of Arcadia on November 28. 1955, the petition
of the Goodyear Tire and Rubber Company, Inc., for a zone variance
to permit the following described property in the City of Arcadia,
County of Los Angeles, to wit:
The east 30 feet of Lot 14 and the east 12 feet
of the vacated alley adjacent on the west; and
the west 57 feet of Lots 15, 16 and 17. Block
74, Santa Anita Tract, as shown on map recorded
in Book 15, pages 89 and 90, of Miscellaneous
Records of said county,
located at 55 East Huntington Drive, to be used for the purpose of
installing and operating equipment for repairing and recapping
tires. That after due notice as required by law, a publiC hearing
on the matter was held by and before said City Planning Commission
on the 13th day of December, 1955, at which time all interested
persons were given a full opportunity to be heard and to present
evidence. That thereupon said Commission on January 24, 1956,
adopted its certain Resolution No. 210, wherein and whereby it
made certain findings and recommendations to this Council.
SECTION 2. That there were protests, both oral and writ-
ten, to the granting of the requested variance. That the subject
property is presently zoned C-2 and the granting of the requested
variance is not necessary for the preservation of substantial prop-
erty rights of the applicant. for the reason that the subject prop-
erty as well as other properties in the same vicinity and zone are
presently useful for and for a long time have been used for the
purposes for which they are zoned. That the granting of the requested

variance would, by reason of the nature of the use which would
thereby be authorized, injuriously affect adjacent properties and
the business of tire recapping would not be desirable in the heart
of a business district nor compatible to the uses therein. That
tire recapping is a use specified as permissible in Zone M-l, and
should not be permitted in ,more restrictive zones except for reasons
much more cogent than any shown to affect the subject property.
That there are no exceptional circumstances applicable to the in-
tended use of subject property and no exceptional circumstances applic-
able to the property itself as to require the granting of the re-
quested variance.
SECTION 3. That for the foregoing reasons, the petition
of the Goodyear Tire and Rubber Company, Inc. for a variance to per-
mit the use of the above described property for tire repair and re-
capping be and the same is hereby denied.
SECTION 4. The City Clerk shall certify to the adoption
of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the
21st
day of February ,1956, by the affirmative
vote of at least three Councilmen, to wit:
