HomeMy WebLinkAbout2758 RESOLUTION NO. 2758 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING AN APPLICATION FOR A VARIANCE TO PERMIT CERTAIN PROPERTY IN AN R-3 ZONE TO BE USED FOR A PROFESSIONAL OFFICE. THE ~ITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on January 19, 1956, the petition of David F. and Helen K. Buckingham for a variance to permit the use of an apartment, located in an R-3 Zone at 5 East Floral Avenue, described as Lots 4 and 5, Tract No. 7820, as shown on map recorded in Book 83, page 20, of Maps, records of Los Angeles County, as a dental office. That after due notice as required by law, a public hearing on the matter was held by and before said City Planning Commission on the 14th day of February, 1956, at which time all interested persons were given a full opportunity to be heard and to present evidence. That thereupon said Commission on March 13, 1956, adopted its certain Resolution No. 213, wherein and whereby it made certain findings and recommendations to this Council. SECTION 2. That there were protests, both oral and writ- ten, to the granting of the requested variance. That professional offices should be restricted to the zone permitting them and not be allowed in a residential zone from which they have been eliminated. That at the present time there is vacant C-2 property in the neigh- borhood available for such professional office use. That the de- velopment and use of Floral Avenue is entirely residential and the granting of the variance is not necessary for the preservation and enjoyment of any substantial property rights of the applicant pos- sessed by other property in the same vicinity and zone. That the granting of such a variance would be detrimental and injurious to -1- JNDl'XEIl 2758 . the R-l property on Floral Avenue to the east. That there are no exceptional or extraordinary circumstances applicable to the prop- erty that do not apply generally to the property or class of use in the same vicinity or zone. SECTION 3. That for the foregoing reasons, the petition of David F. and Helen K. Buckingham, for a variance to permit the use of the above described property for a dental office be and the same is hereby denied. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
