HomeMy WebLinkAbout2759 , RESOLUTION NO. 2759 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DENYING AN APPLICATION FOR ZONE RECLASSIFICATION AND GRANTING A ZONE VARIANCE. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission of the City of Arcadia on the 14th day of December, 1955, the application of Herbert Kalliwoda, as owner, for a zone reclassi- fication from Zone C-2 to Zone M-l of the followin~ described real property in the City of Arcadia, County of Los Angeles: A portion of Lot 69, Santa Anita Colony, as shown on map recorded in Book 42, page 87, of Miscellaneous Records of Los Angeles County, described as follows: Beginning at the intersection of the west line of said Lot 69 with the north line of Live Oak Avenue; thence North 80005'15" East along said north line 101.24 feet; thence North 0055'35" West 113.36 feet; thence South 89003125" West 100 feet; thence South 0055135" East 129.17 feet to the point of beginning, being the south portion of the property known as 82 West Las Tunas prive. That after notice as required by law, a public hearing on the matter was held by and before said City Planning Commission on the lOth day of January, 1956, at which time all interested persons were given a full opportunity to be heard and'to present evidence. That thereupon said Commission on February 14, 1956, adopted its certain Resolution No. 210-A, wherein and whereby it made certain findings and recommendations to this Council. SECTION 2. That there were numerous written communications both for and against the granting of the requested M-l zoning. That if the requested M-l zoning be granted, it would not be legally pos- sible to restrict the use of the property to the limited M-l uses requested in the application. That the reclassification of the . -1- ';hl--:-~"'~"" 2759 subject property as requested would not assist in but would hinder the orderly development and utilization of the subject property and of the entire area. That the requested reclassification is not necessary for the protection of substantial property rights of the aPPlicant for the reason that the full enjoyment of the property for the uses intended can be accorded and protection to adjacent areas afforded by the granting of a variance for the purposes requested. SECTION 3. That for the foregoing reasons the requested M-l reclassification should be and the same is hereby denied. That in lieu of the requested reclassification, the variance heretofore granted under Resolution No. 2002 and extended under certain condi- tions under Resolution No. 2116, is hereby extended for a period of three years and is enlarged to include all of the subject property and the following additional equipment; air compressors, limited to 210 cubic foot delivery; dump trucks, limited to 5-yard capacity; pavement rollers, maximum capacity 5 tons; skip loaders and tractors, limited to Ford-Ferguson type. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 3rd day of April , 1956, by the affirmative vote of at least three Councilmen, to wit: AYES: Councilmen Camphouse, Dennis, Dow, Hulse and Phillips NOES: None ABSENT: None ~~?
