RESOLUTION NO. 2761
RESOLUTION OF THE CITY COUNCIL
OF THE CITY OF ARCADIA, CALIFORNIA,
ORDERING A REPORT UNDER THE
SPECIAL ASSESSMENT INVESTIGA-
TION, LIMITATION AND MAJORITY
PROTEST ACT OF 1931.
(VEHICLE PARKING DISTRICT NO.1)
WHEREAS, on March 29 , 1956, a petition under
the Vehicle Parking District Law of 1943 (Part 1 of Division
18 of the Streets and Highways Code), was filed in the office
of the City Clerk for a vehicle parking district in the vicinity
of First Avenue, Huntington Drive and Indiana Street
j and
WHEREAS, said City Clerk has caused said petition
to be checked and has presented to this City Council said
petition and his certificate that it is signed by the requisite
number of qualified signers as specified in Section 31569.1
of the Streets and Highways Code;
NOW, THEREFORE, the City Council of the City of
Arcadia, California
, does hereby RESOLVE, DETERMINE
AND ORDER as follows:
Section 1. That said petition and said certificate
of the City Clerk each contain all of the matters and things
required by said Law and that said petition is signed by the
requisite number of qualified signers as specified in aaid
Section 31569.1 and ia in all respects a good and sufficient
petition.
Section 2. That said proposed district shall be
designated and referred to in the proceedings for the forma-
tion thereof as "Vehicle Parking District No.1
of the
City of Arcadia, California
"

Section 3. That the exterior boundaries of said
proposed district in said city and to be specially assessed
to pay all or any part of the cost of the proposed acquisi-
tion and improvement are generally described as follows:
Beginning at the intersection of the center lines
of Huntington Drive and First Avenue, thence northerly
along the center line of said First Avenue to the center
line of Indiana Street; thence aoutheasterly along the
center line of said Indiana Street to the center line
of Huntington Drive; thence westerly along the center
line of said Huntington Drive to the point of beginning.

Section 4. That the nature, location and extent
of the proposed acquisition are as follows:
The acquisition in fee simple of lands in said city
for public parking places described as follows:
PARCEL NO.1: Lots 23 and 24, Block 75, Arcadia
Santa Anita Tract, Miscellaneous Records, Book 15,
Page 89, Official Records of Los Angeles County.
PARCEL NO.2: Lots 29 and 30, Block 75, said
Arcadia Santa Anita Tract.

Section 5. That the nature, location and extent
of the proposed improvement are as follows:
The improvement of said parking places by work
and improvement generally described as follows:
(1) Clearing and grading of Parcel No. 1 and
Parcel No. ~, including the removal of any existing
structures or other obstructions.
(2) Paving of Parcel No. 1 and Parcel No. 2
with asphaltic concrete pavement.
(3) Construction of driveway approaches on
Parcel No. 1 and Parcel No.2.
(4) Construction of wheel-bumpers on Parcel
No. 1 and Parcel No.2.
(5) Painting stall lines, directional lines
and arrows, and installation of appropriate informa-
tion signs.
(6) Any necessary work or materials appurte-
nant to any of the foregoing.

Section 6~ That the law under which the proceedings
are to be conducted is the said Vehicle Parking District Law
of 1943.
Section 7. That the bonds are to be issued under said
Law to represent assessments not paid within thirty (30) days
after the date of recordation of the assessment. Said bonds
shall extend over a period of nineteen (19) years from the
2nd day of January next succeeding the next October 15th fol-
lowing their date. The maximum rate of interest to be paid on
said bonds shall be six percent (6%) per annum, payable as
provided in said Law.
Section 8. That Lawrence J. Thompson
is hereby directed to procure the required information and
prepare and present to this City Council the report required
by the Special Assessment Investigation, Limitation and
Majority Protest Act of 1931 as set forth in Division 4 of
the Streets and Highways Code.
Section 9. That the amount or percentage, if any,
proposed to be paid toward the cost of such acquisition and
improvement from any source other than special assessments
upon benefited property is $None.

Section 10. That pursuant to Section 31569.1
of the Streets and Highways Code said petition contains
a request that if the petition is signed by owners, as
defined in Section 31530 of said code, owning landa
and improvements thereon of an asseased value of not
less than 60% of the total assessed value of all lands
in the proposed district and the improvements thereon,
as defined in said Section 31530, which lands also
constitute more than one-half of the area of all lands
in the proposed district, then in lieu of the limit
provided by Section 31569 of said code, the limit on
the aaseasment shall be an amount not exceeding 35%
of the assessed valuation of all land in the district
subject to assessment and all improvements on such land,
as shown by the last equalized county assessment roll at
the date the assessment is confirmed. This City Council
hereby determines that said petition is signed as
specified in such request, and accordingly the limit
stated in said section 31569.1 shall be substituted
for the limit stated in said Section 31569 and ahall
be applicable to the district formed pursuant to aaid
petition.
