HomeMy WebLinkAbout2772 RESOLUTION NO. 2772 A RESOLUTION OF Trill CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A VARIANCE TO PERMIT THE EXTENSION AND i.lODERNIZATION OF EXISTING ELECTRIC DISTRIBUTION FACILITIES. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERlUI\'E AND RESOLVE AS FOLLO\'lS: SECTION 1. That there was filed with the City Planning Commission on February 24, 1956, the application of the Southern California Edison Company, as owner, for a zone variance to permit the modernization and extension of existing electric distribution substation, including fencing with an eight-foot high chain link fence, on the :ollowing described property, to wit: Lots 17 and 18, Block 81, Santa Anita Tract, as per ~ap recorded in Book 15, pages 89 and 90, of Niscellaneous Records of Los Angeles County, located on the west side of Second Avenue north of st. Joseph Street. That after notice as required by Ordinance No. 760 of the City of Arcadia, a public hearin~ was duly held by and before said Commission on the 27th day of March, 1956, at which time all interested persons were given a full opportunity to be heard and to present evidence. That upon the conclusion of said hearing, said Commission adopted its certain Resolution No. 218, wherein and whereby it made certain findings and recommendations to this council. SECTION 2. That subject property is now zoned R-3; that property to the east of subject property is zoned M-l and used for manufacturing purposes. That the plans submitted showed the moderni- zation of existing equipment as well as the extension of present facilities; and the applicant stated that there would be no noise, noxious fumes or odors in connection with the operation of the plant. SECTION 3. That the use of property for public utilities for which the variance is herein requested, is by its very nature -1- li,o,.._ ) 2"(22 an exceptional circumstance applicable to the intended use of the property that does not apply generally to the class of use in the same vicinity and zone and such public utilities must be located where required in order to serve a community. That the granting of the requested variance will not be materially detrimental to the pUb- lie health or welfare, or injurious to property or improvements in such zone or vic~nity. That such a variance is necessary for the preservation and enjoyment of a substantial property riGht of the applicant possessed by other property in the same zone and vicinity for the reason that variances have been granted to neighborinG prop- erties to permit and promote their proper use and development; that the granting of the requested variance will not adversely affect the comprehensive general plan. SECTION 4. That for the foregoing reasons a variance is hereby granted to permit the modernization and extension of the electric distribution substation, including the installation of an eight-foot high chain link fence on Lots 17 and 18, Block 81, Santa Anita Tract. SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
