HomeMy WebLinkAbout2604 RESOLUTION NO. 2604 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A VARIANCE TO PERMIT CON- STRUCTION, MAINTENANCE AND OPERATION OF A MEDICAL OFFICE CENTER THEREON. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission the petition of Ralph T. and Flora E. Merriam, as owners, for a variance to permit the following described property, to-wit: Lots 12 and 13, Tract No. 2828, as shown on map recorded in Book 33, page 63, of Maps, records of Los Angeles County; to be used for the construction, maintenance and operation of a medical and professional office building and prescription pharmacy thereon. That after notice as required by Ordinance No. 760 of the City of Arcadia, a publiC hearing was duly held by and before said Commission on the 8th day of February, 1955, at which time all in- \ terested persons were given a full opportunity to be heard and to present evidence. That upon the conclusion of said hearing, said Commission adopted its certain Resolution No. 183, wherein and whereby it made certain findings and recommendations to this Council. SECTION 2. That there were no protests to the granting of the requested variance if limited to a medical center. That the subject property has for many years been classified Zone R-3. That until the adoption of Ordinance No. 900 subject property could law- fully be used for the construction, maintenance and operation of a medical office; that the applicant is also the owner of property adjacent to subject property, all of which properties were acquired for the purpose of and planned for the full utilization thereof as - 1 - 2604 .,.,..t'~) r,.'" a medical office center. That a large portion of this plan had been completed just prior to the adoption of Ordinance No. 900. SECTION 3. That the granting of the variance for the construction, maintenance and operation of a medical office center upon the above described property is necessary for the preservation of substantial property rights of the applicant for the foregoing reasons. That the granting of such variance will not be incon- sistent with good p~anning practice nor with the provisions of the master zone plan, nor with the present or prospective development of the neighborhood in which ~he property is located, but rather in conformity with each of the foregoing. That the granting of such a variance will not adversely affect the comprehensive general plan nor will it be materially detrimental to property or improve- ments in the vicnity or zone in which the property is located. SECTION 4. That for the foregoing reasons a variance is hereby granted to permit the above described property to be used for the construction, maintenance and operation thereon of a medical office center upon the following terms and conditions: 1. That subject property shall be used only for those uses permitted in Subsections d, e, f, i, j, k, 1 and n of Section 8.l-A-2 of Ordinance No. 760 as amended by Ordinance No. 900; 2. That the southerly 30 feet of Lots 12, 13 and 14, Tract No. 2828, be dedicated for alley purposes; 3. That the violation at any time of anyone or more of the foregoing conditions shall constitute grounds for the cancel- lation of the entire variance hereby granted. SECTION 5. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council held on the 21st day of June, 1955, by the affirmative vote of at least three Councilmen, to-wit: - 2 - 2604 AYES: Councilmen Camphouse, Dow, Hulse and Phillips NOES: None ABSENT: Councilman Dennis ~ -~- C ~ Deputy ~k of ~f Arcadia f June, 1955.
