RESOLUTION NO. 2616
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY. OF ARCADIA. CAl;.IFORNIA,
DECLARING ITS OPPOSITION.TO ASSEMBLY
BILL NO. 1459
WHEREAS, Assembly Bill No. 1459 was introduced at the cur-
rent session of the California State Legislature by Assemblyman
Ernest R. Geddes; and
WHEREAS, Assembly Blll No. 1459 proposes to amend sections
of the Californla Health and Safety Code relative to the powers ot
county sanitatlon districts with reterence to rubbish collection,
transter and disposal; and
WHEREAS, Assembly Bill No. 1459, as introduced ls pre-
sently proposed to be further amended to ellminate some ot the
obvlous opposition to and detects in said Bill No. 1459;
NOW, THEREFORE, the City Council ot the City of Arcadia
does determlne and resolve as follows:
SECTION 1; That Assembly Bill No. 1459, as introduced, it
amended as presently proposed, provides tor some improvements ot
existing legislation; that sald legislation, however, would enable
county sanitation distrlcts to engage in the business of transter and
disposal of rubbish. That sald power, coupled wlth the power of
eminent domain, can well lead to a dlstrict monopoly of the field of
rubbish disposal. That the proposed legislation would on its tace
leave the function ot rubbish collectlon in the hands of local govern-
ment and private industry; however, the control ot rubbish disposal
is in effect also the control of rubbish collection, and such legis-
latlon could be the opening wedge to the entry of government into a
field of operation whlch has in the past been handled either by local
government or private industry. That such legislation, if it is to
be favorably considered, should provide adequate safegaurds tor the
preservation of the compet1tlve factors of private lndustry so that

district operations in the field,of rubbish disposal wlll be etfec~-
tively controlled as to cost ot operation by the wholesome leveling
lnfluence of prlvate enterprise and ingenuity. That although
Assembly Bill No. 1459, as lntroduced and as proposed to be amended,
contains purely permissive provisions, such permlssive provisions
coupled with the power ot condemnation and the removal of private
enterprise all too otten combine to the detriment of the persons

whom such permisSive provisions were intended to serve.
SECTION ,2. That for the foregoing reasons the City Council
of the City of Arcadia does hereby urge that Assembly Bill No. 1459
either be tabled for intensive study, or if lt ls to be favorably
consldered that the same be further amended to include adequate
safeguards for the protection ot private industry in the field of
rubbish disposal and the maintaining of the leveling factor of prl-
vate competition ln the field to be entered by district government,
and by including therein provlsions enabling county sanitation dis-
tricts to contract with the owners of existing disposal facilities
when such facilities are in operation and adequate to meet the needs
of the district for rubbish dlsposal purposes.
SECTION 3. The Clty Clerk shall certify to the adoption
of this Resolution and shall cause coples thereof to be sent to
Honorable Ernest R. Geddes, Honorable Frank Lanterman,
and other members of the State Assembly and Senate.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the 5th day of April, 1955, bW the affirmative vote of at
least three Councilmen, to-wit:
