Gentlemen:
In our letter of July 10, 1952, we set forth certain charges
in connection with the conducting of proceedings for the formation of
assessment districts under the Improvement Act of 1911.
We wish to modify that letter agreement by providing that
the fee for our services as set forth in said letter will be a sum
equal to 2% of the construction costs of the project, exclusive of
any incidental expenses, with a minimum fee of $300.00.
We wish to further modify the letter by providing that the
fee shall be paid at the following times:
An amount equal to 1% of the estimated amount of any con-
tract to be entered into for the construction of any improvement shall
be collected from the contractor as incidental expense and shall be
paid to us within fifteen days after the date of the execution of the
construction contract. The balance of said fee shall be due and
payable when the assessment of said improvement is confirmed by the
City Council and recorded by the Superintendent of Streets.
If the above modifications are agreeable to you will you
please approve the same by resolution. The resolution should instruct
the Mayor to execute this instrument by signing and returning to us the
carbon copy of this letter; and, further, the Council by said resolu-
tion should find and determine that these fees be a part of the inci-
dental expenses of the project.
Respectfully yours
