HomeMy WebLinkAbout2622 RESOLUTION NO. 2622 - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA EMPLOYING SPECIAL COUNSEL FOR THE FORMATION OF PROPOSED IMPROVEMENT DISTRICTS AND SPECIFYING THE RATE AND TERMS OF COMPEN- SATION THEREFOR. WHEREAS, there are certain improvements proposed to be made within the City of Arcadia; and, WHEREAS, it is proposed that the properties to be bene- fitted by said improvements be formed into a district therefor and assessed for the cost thereof; and, WHEREAS, it is advisable to employ special counsel for handling the proceedings for the formation of such districts: NOW, THEREFORE, the City Council of the City of Arcadia does hereby determine and resolve as follows: SECTION 1. That the firm of Burke, Williams & Sorensen be employed to handle the formation of assessment districts to be formed under the Improvement Act of 1911 on the terms and conditions set forth in their lettaEof July 10, 1952, and April 15, 1955. SECTION 2. That the City Manager hereby is authorized to employ said firm to handle the formation of future proposed assess- ment districts under the Improvement Act of 1911, upon the terms and conditions set forth in said letters, when the City Manager has been directed to proceed in the formation of such districts by the City Council, and the firm of Burke, Williams & Sorensen accepts employ- ment upon the terms and conditions set forth in said letters. SECTION 3. The Mayor and City Clerk are hereby instructed to execute such contract of employment for and on behalf of the City of Arcadia by endorsing approval thereof on copies of said letter of April 15, 1955, and returning one copy thereof thus endorsed to said firm. - 1 - 2622 ~~~ SECTION 4. The City Council does hereby find and determine that the compensation of said special counsel hereby employed shall be a part of the incidental expenses of the respective projects in con- nection with which such legal services are thus rendered. SECTION 5. The City Clerk shall certify to the adoption of this resolution. April 15, 1955 City Council City Hall Arcadia, California Gentlemen: In our letter of July 10, 1952, we set forth certain charges in connection with the conducting of proceedings for the formation of assessment districts under the Improvement Act of 1911. We wish to modify that letter agreement by providing that the fee for our services as set forth in said letter will be a sum equal to 2% of the construction costs of the project, exclusive of any incidental expenses, with a minimum fee of $300.00. We wish to further modify the letter by providing that the fee shall be paid at the following times: An amount equal to 1% of the estimated amount of any con- tract to be entered into for the construction of any improvement shall be collected from the contractor as incidental expense and shall be paid to us within fifteen days after the date of the execution of the construction contract. The balance of said fee shall be due and payable when the assessment of said improvement is confirmed by the City Council and recorded by the Superintendent of Streets. If the above modifications are agreeable to you will you please approve the same by resolution. The resolution should instruct the Mayor to execute this instrument by signing and returning to us the carbon copy of this letter; and, further, the Council by said resolu- tion should find and determine that these fees be a part of the inci- dental expenses of the project.
