A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA, CALIFORNIA,
CLASSIFYING THE STORAGE OF DRAYING
EQUIPMENT AS A USE PERMISSIBLE IN
ZONE M-l UNDER ORDINANCE NO. 760 OF
THE CITY OF ARCADIA
WHEREAS, the storage of draying equipment is nowhere
listed as a use permissible in any zone under Ordinance No. 760 of
the City of Arcadia; and,
WHEREAS, a pub~ic garage is used among other things for
the storage of motor vehicles; and,
WHEREAS, Section ll-A-39 specifies storage space for
transit and transportation equipment as a use permissible in Zone
M-l under said Ordinance; and,
WHEREAS, ambiguity has arisen by reason of the foregoing
provisions concerning the use of a service station in Zone C-2 for
the purpose of storing, while not in use, of draying equipment
used in the collection of refuse or junk; and,
WHEREAS, Section 15 of Ordinance No. 760 provides that
if any "Use" is for any reason omitted from the lists of those
specified as permissible in each of the various zones, it shall be
the duty of the City Planning Commission to ascertain all pertinent
facts concerning said use, and by resolution of record set forth
its findings and the reasons thereof, and such findings and resolu-
tions shall be referred to the City Council and, if approved by the
City Council, thereafter such interpretation shall govern; and,
WHEREAS, said Planning Commission has ascertained the per-
tinent facts concerning the storage of draying equipment, and has
made its findings and recommendations pursuant to said Section 15
of Ordinance No. 760 by and under its certain Resolution No. 188,
adopted April 26, 1955; and,
WHEREAS, the City Council has fully considered the matter
and deems it necessary and advisable that the storage of draying

equipment be classified as recommended by the City Planning Commis-
sion;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA
DOES HEREBY FIND, DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That the temporary storage of draying or trans-
portation equipment is a use permissible in Zone C-2 only as a use
included within and incidental to the business of a public garage,
and is not a use included generally in the uses specified as per-
missible in Zone C-2; that the storage of transportation equipment
at a service station in Zone C-2 is not a use permissible in Zone
C-2 as being incidental to the use of the premises for a service
station; that the incidental use of a service station is limited to
the temporary parking of transportation equipment thereat for such
time as is reasonably necessary for the servicing of such equip-
ment; that the storage of transit and transportation equipment, of
itself, is a use specified as permissible in Zone M-l under Section
11 of Ordinance No. 760, and is not permissible in any less restric-
tive zone under Ordinance No. 760 of the City of Arcadia.
SECTION 2. The City Clerk shall certify to the adoption
of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of the City Council of the City of Arcadia,
held on the 17th day of May, 1955, by the affirmative vote of at
least three Councilmen, to-wit:
