A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA
CALIFOR;r.rA, SETTING A HEARING FOR THE PURroSE OF IETERMINING

AVENUE ALL l'lITHIN THE CITY OF ARCADIA.
UHEP-EAS, Section 17 of Article XIII of the Constitution of the State
of California provides that the debt limitation and majority protest provisions
of said section shall not apply i:f, after the giVing o:f such reasonable notice
by publication and posting and the holding of such public hearing as the City
Council of the City of Arcadia shall have prescribed, said council by no less
than a 4/5ths vote of all members thereof, :finds and determines that the public
convenience and necessity require the improvement proposed to be made; and
UHEREAS, Section 2804 o:f the Streets and H:i.ghl-Tays Code of the State
of California proVides that the "Special Assessment Investigation, Limitation
and JoIajority Protest Act of 1931" shall not apply to any proceeding otheI'l-Jise
subject thereto ,rhen said improvement proceeding is by a charterc:i.t~' and said
city has complied With the proviSions of Section 17 of Article XIII of the
Constitution of the State of California; and
mlEREAS, the City of Arcadia is a charter city of the State of
California.
NO.1, THEREFORE, THE CITY COUNCIL OF THE CITY OF AllJADIA DOES RESOLVE
AS :FOLLCMS:
SECTION 1. That said City Council proposes to initiate proceedings
for the improvement of First Alley south of Foothill Boulevard between Higwam
Avenue and Fifth Avenue, and First Alley south of Dj.amond Street bet1-1een First
Avenue and Second Avenue, and First Alley south of Laurel Avenue betweez:l Second
Avenue and Fifth Avenue, and First Alley south of noral Avenue bet\-Teen North
Vieu Avenue and Fifth Avenue, and Second Avenue bet,reen Forest Avenue and Laurel
Avenue, all ,rithin the City of Arcadia, by the gt'ading, preparing subgrade,
paving, and the construction of cor.crete curbs, gutters and aprons and
appurtenant nork thereto. The nature, location, and extent of the proposed
improvement and the district to be assessed for the cost and expenses thereof

are as shmm :respectively on the plan and profile No. 229, adopted by the City
Council of the City of !\rcodia, by Resolution No. 2636 on June 7, 1955,
and assessment district map No. l'l.66 adopted by said City Council by Resolution
No. 2637 on June 7, 1955 , and on file in the office of the City
Engineer and the office of the City Clerk of said city and in accordance with
specification entitled IlJob No. 229, Improvement of the First Alley south of
Foothill Boulevard and other Alleys and Streets, whioh said specification duly
,-Tas adopted by said City Council by Resolution No. 2636 on the 7th day
of June , 1955, uhich said plan and profile, assessment
district map and specification nOl'T are on file in the office of the City Engineer
and of the City Clerk of said city, to which said plan and profile, assessment
district map and specification reference is made for all particulars relative
thereto.
SECTION 2. That the total estimated cost of the proposed improvement
is 025,485.42.
SECTION 3. That the said improvement shall be conducted under the
Improvement Act of 1911, uhich is Division 7 of the Streets and Ilighl~ays Code
of the State of California.
SECTION 4. That notice hereby is given that on the 5th day of
July, , 1955, at 8: 00 P.H. in the Council Chamber located
in the City Hall of said city, there shall be a public hearing before said
City Council for the purpose of determining l-Thether the public convenience
and necessity require the above described improvement.
SECTIOn 5. That the City Clerk shall give notice of the hearing
by posting a copy of this resolution in the manner prescribed by Section 5065
of the Streets and Highways Code and by publication as hereinafter provided.
Any person interested may m~,e protest aeainst the proposed improve~ent in
~Triting filed with the City Clerk at any time not later than the hour set
for the hearing in the manner provided by Section 5220 of the Streets and
Highways Code.

SECTION 6. That the City Clerk hereby is directed to
publish this Resolution in the Arcadia Bulletin on two successive dates,
the first publication to be made not less than ten (10) days prior to
the date of the above public hearing.
SECTION 7. The City Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be in full
force and effect.
