HomeMy WebLinkAbout2640 RESOLUTION NO. 2640 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, GRANTING A VARIANCE TO PERMIT CON- STRUCTION, MAINTENANCE AND OPERATION OF A MEDICAL BUILDING AT III EAST LIVE OAK AVENUE IN SAID CITY THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOlofS: SECTION 1. That there was filed with the City Planning Commission on April 15, 1955, the petition of H. N. Berger, as owner, for ,a zone variance to permit the following described prop- erty, to-wit: Lots 2 and 3, Tract No. 12915, as shown on map recorded in Book 270, page 10, of Maps, records of Los Angeles County, to be used for the construction, maintenance and operation of a medical building thereon; and that after notice as required by Ordinance No. 760 of the City of Arcadia, a public hearing was duly held by and before said Commission on the 26th day of April, 1955, at which time all interested persons were given a full opportunity to be heard and to present evidence. That upon the conclusion of said hearing, said Commission adopted its certain Resolution No. 191 wherein and whereby it made certain findings and recommendations to this Council. SECTION 2. That there were no protests to the granting of the requested variance. That the subject property is in an R-3 Zone, and could, until the adoption of Ordinance ,No. 900, lawfully be used for the construction, maintenance and operation of a medical office. That it is in an area now being considered for rezoning to the c-o Professional Office Zone and that there are other medical buildings in the area. SECTION 3. That the granting of a NaT~ance as hereinafter , - 1 - 2640 ~S>~ ".W" recommended is necessary for the preservation of substantial prop- erty rights of the applicant for the foregoing reasons. That the granting of the variance as hereinafter recommended will not be in- consistent with good planning practice, nor with the provisions of the master zoning plan, nor with the present or prospective develop- ment of the neighborhood in which the property is located, but rather in conformity with each of the foregoing. SECTION 4. That for the foregoing reasons a variance is hereby granted to permit Lot 2, Tract No. 12915 to be used for the construction, maintenance and operation thereon of a medical office ~ building upon the condition that the property shall be used for only those uses permitted in Subsections d, e, f, i, J, k, 1 and n of Section 8.1-A-2 of Ordinance No. 760 as amended by Ordinance No. 900; and that the requested variance is hereby denied as to Lot 3, Tract No. 12915, unless and until an alley twenty (20) feet in width is dedicated across said Lot 3 at a location approved by the City Planning Commission and the City Engineer. SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
