HomeMy WebLinkAbout2657 RESOLUTION NO. 2657 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA; CALIFOmp:A; GRANTING A VARIANCE TO PERMIT, THE CONSTRUCTION OF A DUPLEX AT.24l OAKHURST LANE THE CITY COUNCIL OF THE CITY OF ARCADIA; CALIFORNIA; DOES FIND; DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That there was filed with the City Planning Commission on May l7, 1955, the petition of Lorraine M. Stettler and Robert H. Stettler, as owners, for a zone variance to permit the following described property, to wit: That portion of Lot 5, Tract No. l3487, as shown on map recorded in BOok 272, pages~ and l5, of Maps, records of Los Angeles County bounded southeasterly by the following described line: Beginning at the most southerly corner of said lot, the southerly line of said Lot 5 having a bearing of South 78009'12" West;, thence north 16031'07" east 91.63 feet; thence north 66019'43" east 293.76 feet to the easterly line or said Lot 5, to be used for the construction and maintenance thereon of a duplex with attached garage; and that after notice as required by Ordinance No. 760 of the City of Arcadia, a public hearing was duly held by and before said Commission on the 14th day of June, 1955, at which time all interested persons were given a full opportunity to be heard and to present evidence. That upon the conclusion of said hearing said Commission adopted its certain Resolution No. 197, wherein and whereby it made certain findings and recommendations to this Council. SECTION 2. That there were no protests to the granting of the requested variance. That subject property is classified Zone ~l; that it contains approximately 30,000 square feet, sufficient for two residences if in separate buildings, but that it backs up to the Santa Fe Railroad right of way and there is a storm drain channel cutting through the easterly portion of the parcel, making .-l- 2657 C)I!m'.!''c" the easterly half undesirable for residential purposes. That a variance has been granted for multiple family residences on the prop- erty to the south. SECTION 3. That the granting of a variance as hereinafter recommended is necessary for the preservation of substantial prop- erty rights of the applicant for the foregoing reasons. That the granting of the variance as hereinafter recommended will not be inconsistent with good planning practice, nor with the provisions of the master zoning plan, nor with the present or prospective development of the neighborhood in which the property is located, but rather in conformity with each of the foregoing. SECTION 4. That for the foregoing reasons, a variance is hereby granted to permit the above described property to be used for the construction and maintenance thereon of a duplex with attached garage on the condition that no additional residences shall be constructed on said property so long as the duplex hereby authorized is maintained or used for occupancy as a dwelling for more than one family. SECTION 5. The City Clerk shall certify to the adoption of this Resolution.
