RESOLUTION NO. 2688
A RESOLUTION OF THE CITY COUNCIL OF
THE CITY OF ARCADIA. CALIFORNIA.
GRANTING A VARIANCE FOR THE
CONSTRUCTION; MAINTENANCE AND
OPERATION OF A MINIATURE GOLF COURSE
AT 615 WEST LAS TUNAS DRIVE UPON
CERTAIN SPECIFIED CONDITIONS.
THE CITY COUNCIL OF THE CITY OF ARCADIA; CALIFORNIA; DOES

FIND; DETERMINE AND RESOLVE AS FOLLOWS:
SECTION 1. That there was filed with the City Planning
Commission on August 25. 1955. the petition of Ralph D. and Lula P.
Stogsdill. as owners. for a zone variance to permit the following
described property. to wit:
The east 120 feet of Lot 23; the east 120 feet
of Lot 24; and the north 41 feet of the east
113 feet of Lot 41. Tract No. 6641. as shown on
map recorded in Map Book 126. page 67. in the
office of the County Recorder of Los Angeles
County.
being a parcel of land on the south side of Las Tunas Drive approxi-
mately 117 feet east of Baldwin Avenue. having a frontage of 120
feet and a depth of 205 feet. to be used for the establishment and
maintenance of a miniature golf course; and that after notice as
required by Ordinance No. 760 of the City of Arcadia. a public hear-
ing was duly held by and before said COmmission on the 13th day of
September. 1955~ at which.time all interested persons were given a
full opportunity to be heard and to present evidence. That upon
the conclusion of said hearing said Commission adopted its certain
Resolution No. 204. Wlerein and whereby it made certain findings
and recommendations to this Council.
SECTION 2. That the only protest was filed by a resident
living more than a block away from subject property; that the owners
of all lots on the south side of Las Tunas Drive within 300 feet of
subject property. the owners of all lots on the east aide of Baldwin
Avenue between Las Tunas Drive and Workman Avenue and the owners of

several 10ts on the north side of Las Tunas Drive signed a petition
filed by James F. Murray for a s1md1ar variance on the same portion
of Lot 24. That subject property is now in Zone R-l but that an
application for change of zone to C-l, upon recommendation of the
Planning Commission. is now set for hearing before this Council;
that variances have been granted in the past for the southeast cor-
ner and the northeast corner of Baldwin Avenue and Las Tunas Drive
and for other property 10cated within 300 feet to the east of sub-
ject property. That the southwest and northwest corners of Las
Tunas Drive and Baldwin Avenue in the county are zoned C-2 and
developed for commercial uses.
SECTION 3. That the granting of the variance as herein-
after prOVided is necessary for the preservation of substantial prop-
erty rights of the applicant and will not be inconsistent with good
planning practice. nor with the provisions of the master zoning
plan. nor with the present or prospective development of the neigh-
, borhood in which the property is 10cated.
SECTION 4. That for the foregoing reasons. a variance is
hereby granted to permit the above described. property to be used
for the construction. maintenance and operation of a miniature golf
course thereon upon the following express conditions:
1. That the only use authorized by reason of the vari-
ance hereby granted is the establishment. maintenance and
operation of a miniature golf course. and shal1 not include
any other uses customarily associated with or conducted in con-
nection with or incidental to a miniature golf course.

2. That the southerly 105 feet of Lot 25. Tract No. 6641.

be improved and at all times maintained and operated as a park-
ing lot. in accordance with the provisions of Section 15. Sub-
section 2-b of Ordinance No. 760. as amended.
3. That no loudspeaker or public address system be in-
stal1ed on the premises or used in connection with the minia-
ture golf course authorized by the variance hereby granted.

4. That all exterior lights on the subject property be
so installed and operated that they do not shine upon or
directly illuminate any adjacent property.
5. That the conduct or use of the miniature golf course
shal1 not be permitted between the hours of 12:00 o'clock mid-
night and 8:00 o'clock A.M. of any day.
6. That the owner and operator of the miniature golf
course shall prohibit and prevent both the possession and con-
sumption of beer. wine and alcoholic liquor on the subject
property so long as the miniature golf course is maintained or
operated thereon, and shall prohibit and preclude the sale of
beer. wine and alcoholic liquor on Lot 25, Tract No. 6641. so
long as the miniature golf course is maintained or operated
on the subject property.
7. That each of the foregoing conditions shall continue
throughout the entire time that the miniature golf course is
maintained or operated on subject property. and the violation
of any of the foregoing conditions at any time shall constitute
grounds for the modification or revocation of the variance
hereby granted.
SECTION 5. The City Clerk shall certify to the adoption
of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular adjourned meeting of the City Council of the City of
Arcadia held on the 28th day of September. 1955. by the affirmative
vote of at least three Councilmen, to wit:
