RESOLUTION NO. 2507 A RESOLGTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA., GRANTn~G AN EXTENSION OF AN EXISTING VARI- ANCE TO PERUIT ADDITIONAL PROPERTY TO BE USED FOR COII- 1ffiRCIAL PURPOS~S ON SPECIFIED CONDITIONS THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEHEBY D~T:2m:n!E AND RESOLVE AS FOLLOnS: . SECTION 1. That there was filed with the City Planning Commission the application of tiarket Basket for the extension of a.n existin~ variance to permit the expansion of commercial uses on the \lest 15 feet of the south 90 feet, 4 inches, of Lot 4, Block 72, Santa Anita Tract, as sho~n on map recprded in Book 15, pages 89 and 90, records of Los Ange~s County. That after due notice as re- quired by la~, a public hearing ~as held by and before' said City Planning Commission on April 13, 1954, at which time all interested persons vere givan full opportunity to be heard and to present evi- . dence. That thereupon the City Planning Commisaion did adopt its certain Resolution No. 152 on May 11, 1954, wherein and whereby cer- tain findings were made and a recommendation that the variance requested should be granted upon conditions therein specified. . SECTION 2. That there were no protests, oral or written, to the granting of the requested variance. That on July 15, 1947, Ordi- nance No. 657 entitled "Air ORDINANCE OF THE CITY COUNCIL OF THE CITY OF A:lCADIA, CALIFORNIA, l:lAKING A PERI.lAHENT EXCEPTION TO CERTAIN PRO- VISIONS OF ORDINANCE NO. 439 OF SAID CITY, ADOPTED JUNE 28, 1940" ,Jas adopted by the City Council pursuant to the recommendation of the City Planning Commission theretofore made. That the facts and circumstances then existing and uarranting the granting of the variance therein pro- vided not only continue but have been increased by the adoption of Ordinance No. 760 and the parking overlay thereby imposed upon adjacent Lot 4. That the findi~s and determinations heretofore made with . - 1 - 2507 . . reference to the subject property are hereby reaffirmed. That the purpose of the requested extension is to permit an addition to the existing building for the installation of refrigeration equipment necessitated by the change in merchandising technique applicable to the business conducted on the subject property. That this is an exceptional circumstance or condition spplicab~ to the intended us~ of the property that does not apply generally to the class of use in the same vicinity or zone. That such extension of variance is necessary for the preservation of substantial property rights of the applicant, possessed by other property in the same vicinity or zone, in that the applicant's property is lawfully developed for and devoted to its present business, as are other properties in the s eme area, and such la\7ful use flill be impaired, if not actually jeopardized, by the failure to make the additions required by recently developed techniques in the merchandising of frozen foods. That the granting of the variance requested upon the con- ditions hereinafter proposed will not be inconsistent with good planning practice or the provisions of the master zoning plan or the present development of the general neighborhood in which said property is located, nor uill the veriance adversely affect the general comprehensive plan. . . SECTION 3. That for the foregoing reasons, the variance heretofore Gran~ed to applicant be extended to permit the con- struction on Lot 4 of a fifteen-foot extension to the building presently constructed on Lots I and 2. That the extension of the variance hereby granted shall continue only so long as the remain- der of Lot 4 and all of Lots 5 and 6 are improved and maintained as public parking lots, whether under applicant's ownership or not; that when any portion of the parking hereby required shall no lon8er be thus maintained, the variance extension hereby granted shall cease, all structures erected hereunder be removed and the . - 2 - 2507 . property reverted to the status provided for in the variance hereto- fore granted under said Ordinance No. 657. This condition shall not preclude the owner of the business conducted on such property from restricting ths use of the parking areas required to ths customers of applicant's business. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. . I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of Arcadia held on the 1st day of June, 1954, by the affirmative vote of at least three Councilmen, to-wit: AYES: NOES: ABSENT: Councilmen Camphouse, Dennis, Dow, Hulse and Kennett None None .
