RESOLUTION NO. 2512 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING PUBLIC POLICY WITH REFERENCE TO THE ORDERLY SUBDIVISION OF PROPERTY WITHIN THE CITY OF ARCADIA WHERijAS, the City Planning crommlssion of the City of Arcadia has fully investigated and considered the matter of the orderly subdivision of individual lots within the City of Arcad1llt, whereupon it did adopt its Resolution No. 155, entitled nA RESOLU- TION OF THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALI- FORNIA, DECLARING PUBLIC POLICY WITH REFERENCE TO THE ORDERLY SUBDIVISION OF PROPERTY WITHIN THE CITY OF ARCADIAn; and WHEREAS, the City Council has likewise considered the matter set forth in said Resolution No. 155 and does hereby approve, o:f the same; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES DETERMINE, RESOLVE AND DECLARE AS FOLLC1tVs:: SECTION 1. That the rapid growth of the City of' Arcadia has practically exhausted the large unimproved areas of' land norm- ally available f'or subdivision; that f'uture subdivision wi thin the City must necessarily be comprised of' existing lots too large for retention as ,,~gle units but seldom. large enough individually to allow proper subdivision; that the orderly planning and development of' such parcels require the cooperation of' the resps ctive owners and the encouragement and assistance, so f'ar as may be proper and legal, of' all governmental agencies having jurisdiction. SECTION 2. Pursuant to the foregoing, it is hereby de- clared to be the policy of' the City Council to f'oster the order~y development and proper planning of' areas to be subdivided. To this end this Cotmcil will encourage, without partisanship, the collec- tive subdivision of' all adjacent parcels properly includable under one plan or within one subdivision. To this end, this Council will - 1 - 251:2 . . . . . approve reasonable measures for the reimbursement of a subdivider of the costs incurred by him in subdividing property, when such costs are incurred at least in part for the ultimate benefit of properties not embraced within such subdivision; that the proper development of many areas requires the installation of improvements out of proportion to the property presently being subdivided, and that adequate prevision should be made for the eventual spreading of such improvement costs over areas actually benefited thereby when and if such other areas desire to and are ready to avail themselves of such benefits. SECTION 3. To accomplish the foregoing, this Council will, as a matter of policy, require in connection with all future subdi- visions that properties not within such subdivisions, but abutting improvements made therein at the cost of the subdivider and to be dedicated to the public, shall be precluded from access to or use of such improvements by (1) the granting of intervening property in fee to the City of Arcadia, or (2) granting intervening property in trust to an impartial corporate title holder upon such conditions as the City Council shall find and determine to be fair and equitable to such subdivider, to the owners of adjacent properties and to the in- habitants of the city generally, or (3) by such other or further means as may be lawful and proper. In furtherance of this policy and for the purpose of facilitating the inclusion within a given subdivision of all property that may be available for inclusion therein, the City Council will cause timely notice of all determinations, to be made within the scope of the policy hereby declared, to be sent to the owners of all parcels of the properties deemed by the City Council to be in any way benefited by the improvements to be constructed therein, unless such notice shall have been given by some agency of the City Government. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. - 2 - 2512 . I HEREBY CERTIFY that the foregoing Resolution was adopted ~ at a regular meeting of the Cit,y Council of the City ot Arcadia held on the 15th day of June , 1954, by the affirmative vote of at least three Councilmen, to-wit: AYES:.
