RESOLUTION NO. 2520
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNI~, DENYING REQUESTED RECLASSI-
FICATION FROM ZONE R-2 TO ZONE 0-2 AND GRANTING
RECLASSIFICATION FROM ZONE R-2 TO ZONE PR-2,
AFFECTING CERTAIN REAL PROPERTY ON SOUTH BALDWIN
AVENUE IN SAID CITY

WHEREAS, there was filed with the City Planning Commia-
sion the pe titian of E. W. Bates as owner of property at 850
South Baldwin Avenue" being a portion of Lot 1, Tract No. 3430,
to change said property from Zone R-2 to Zone C-2;; and
WHEREAS, after due notice as required by law, a public
hearing was held in the matter by and before the City Planning
Commission on May 25, 1954, at which time all interested persons
were given a full opportunity to be heard and to present evidence;
and

WHEREAS, the City Planning Commission did thereupon pass,
approve and adopt its certain Resolution No. 156 entitled n~ RESO-
LUTION OF T HE CITY PLANNING COMMISSION OF T HE CITY OF ARCADIA,
CALIFORNIA, RECOMMENDING THE DENIAL OF T HE REQUESTED ZONE RECLASSI-
FICATION FROM ZONE R-2' TO ZONE C-2 AND RECOMMENDING THE GRANTING
OF THE REQUESTED RECLASSIFICATION FROM ZONE R-2 TO PR,-2 AFFECTING
CERTAIN REAL PROPERTY IN SAID CITyn, wherein and whereby it made
certain findings and recommended the denial of the requested re-
classification to Zone C-2; and further recommended that the re-

quested reclassification to Zone PR-2' be granted; and
WHEREA8~ after due notice as required by law, a public
hearing was held in the matter by and before the City Council of
the City of Arcadia on July 20, 19$4, at whiCh time all interested
persons were given a f'ull opportunity to be heard and present evi-
dence; and whereas the City Council of the City of Arcadia has
fully considered the matter and reviewed the files relative thereto;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA
. DOES HEREBY FIND AND RESOLVE AS FOLLOWS:

SECTION 1. That there were protests to the granting ot:
certain ot: the a!'oresaid ~one reclassifications. That the subject
property is a parcel 40 t:eet by 60 t:eet in size, constituting a
portion of the abandoned Southern Pacific Railroad right of wa:y.
That said parcel is within the alignment of a future street as
shown on Sheet No. 3 of the Block Maps of the City, recommended by
the City Planning Commission on September 30, 1952, and approved
by the City Council on January 6, 1953. That the requested reclassi-
t:ication to Zone C-2 would result in a small segment ot: commercial
property being placed between adjacent residential properties. That
the granting of the C-2 Zone reclassit:ication would be contrl!rY to
the comprehensive general plan, is not necessary far the preserva-
tion of substantial property rights and would be inimical to the
health and welt:are of the residents of the area and detrilD.entlQ to
the adjacent residential properties.
SECTION 2. That subject property has no street t:rontage
opinion of the
and, in the/CounCil, is subject to a parking overlay as a transi-
tional use under the provisions of Ordinance No. 760; that any.
ambiguity or uncertainty in this regard can,. and should be removed
by granting the requested reclassit:ication to Zone PR-2.
SECTION 3. That for the t:oregoing reasons the City Coun-
cil of the City of Arcadia hereby determines that the requested re-
classification of the above described property to Zone C-2 should

be and the same is hereby denied; that the requested reclassifica-

tion to Zone PR-2 should be granted.
SECTION 4. The City Clerk shall certify tothe adoption
of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was
adopted at a regular lIB eting ot: the City Council held on the 3rd
day of August , 1954, by the affirmative vote of at least
three councilmen, to-wit:
