HomeMy WebLinkAbout2526 RESOLUTION NO. 2$26 A RESOWTION OF TIlE CITY COUNCIL OF THE cITY OF ARCADIA, CALIFORNIA, HAKm:l C~TAIN FlNDINGS AND DETERMINATIONS; RELlTIVE TO THE OFF-STREET PARKING ~UIREMENTS FOR HOR- TUARm AND FUNERAL PARIDRS. WllEIlEAS, t.he ma:l.ntsnanca and operation of a funeral parlor is a use permissible 111 Zone C-2 under Section 9 of Ordinance No. 760 of the City" of . Arcadia; and WHEREA.S, Section 1$ Aa-2:-a.-2: provides as folloirsl "For Bnilll1T1gs other tban Dwellings there shall be at least one parking space of two bundred and fifty (250) square feet on the s8llle lot with the main building or contiguous t.hereto lIB follovSJ . . (a) For Churches, High Schools, Colleges and Auditoriums and other places of occasional assembly, at least one (1) parldDg space for every ten (10) seats provided in said building. (b) For Hospitals and Institutions, at least one (1) parking space for every two (2) beds provided in said' buildings. (c) For Hotels and Clubs, at ]sast one (1) parking space for every three (3) guest roOlllS provided in said build- ings. (d) For Theatres, Auditoriums and other lIim11Ar places of assembly, at least one (1) parld.ng space tor every four (4) seats provided inaid building.1I and, WHERFAS, ambiguity has arisen and exists concerning the appropriate ela.ss1fication of funeral. parlors and mortuaries as to the 8lIlount of parking space required therefor and as to the plUicing area require!llente applicable to \ funeral parlore aDd mortuaries under Section 1$ A-2-a.-2. of Orci1.nlnce No. 760; . and, WHERFAS, Section 1S A-1..:1 ot said Or;l"n,,"C'il No. 760 proVides in part II. . . if ambiguity arises concerning the appropriate classification of a particular use within the meaning and intent. of this ortl1n..nee, or it ambiguity exists with reference to matters ot height, yard requirElllllnts, or area reqll1:re- ments as set forth herein and as they T1IBif pertain to unforseen circumstances. it shall be t.he duty ot the City p'1Ann1ng COIIlllIission to ascertain all pertinent . - 1 - 2.$26 . . facts concerning said use and by resolution of record set forth its findings and t.he reasons therefor,lt IUd, WHmEAS, the City PlAnning COIIIIlI1seion has ascerta:l.ned the pertinent facts and fuDy considered ths matter, whereupon it did on March 9. 1954, adopt its certain Resolution No. 139 ent1t.led DA RESOWTION OF 'lHE CITY PIANNIRl COM- MISSION OF THE CITY OF ARCADIA, CALIFORNIA, MAKING CERTAIN DETEilMINATIONS AND REX:OM:-lENDATIONS CONCEmrrNG OFF-STREET PARKmG ~UIREMIlNTS FOR IDRTUARm AND FUNERAL PARLORSD wherein and whereby it made certain detel'lllinations and recom- IlIIlDdations concem:1ng the off-street parking requi.rements for IlIOrtuaries and funeral parlors; and WHEREAS. the City CouncU has 11kevise considered the matter and tbIl recOllllllendations contained in said Resolution No. 139; NON, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES mmmr DETmlMINE AND RESOLVE AS R>LIDWSz SECTION 1. That the mainten&l1ce and operation of funeral parlore aDd IlIOrtuaries are, by reason or their proprietary nature, their purpose aDd their method of operation, logically and properly included within the category of theatres, auditoriUIDS aDd other fl1mil"r places or assembly as provided in Sub- section (d) of Section 1$ A-2-a.-2 of said Ordinance No. 700 rather than within aI\Y of the categories specified in SUbsections (a), (b) or (c) of said Section IS A-2-a-2. That proper p1,."niT1g requires that mortuaries and tuneral. parlors furnish and be required to furnish at least one parking space of two hundred and fifty (2SO) square feet in the same lot with the main building or contiguous thereto tor every tour (4) seats provided in such building, computed in accord- ance with the appUcable provisions ot said Ordinance No. 760. SECTICti 2. That for the foregoing reasons, pursuant to Section 1$ of Ordinance ,No. 760 ot the City of Arcadia, IlIOrtuariea and funeral parlors ahall be required to turnish at least one (1) parking space of two hundred and fifty (2$0) squsreteet on the s8llle lot as the main buiM1ng or contiguoua. thereto for every .1"our (4) seats provided in such building. SECTION 3. The City Clerk shell certif)' to the adoption of this Resolution. . . . - 2 - 2526 . I tu!iIWl!
