RESOLUTION NO. 2534
A RESOLUTION OF THE CITY COUNCn. OF THE CITY OF
ARCADIA. CALIFORNIA, GRANTING A ZONE VARIANCE
AFFECTING CERTAIN REAL PROPERTY IN SAID CITY TO
PEIDlIT THE CONSTRUCTION, MAINTENANCE AND OPERATION
OF A PAROCHIAL SCHOOL AND PLAYGROUND AND RELATED
FACn.ITIES THEREON
THE CITY COUNCn. OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY
FIND, DETERMINE AND RESOLVE AS FOLLO'IiS.

SECTION 1. That there nas filed with the City Planning Commission of
the .City of Aroadia on July 6, 1954, the petition of the Roman Catholic Arch-
. bishop of Los Angeles, as owner. requesting a variance affeoting the following
desoribed real property;in Los Angeles County.
!he Easterly 400 feet measured along the North and South
lines of that portion of Lot 3, Tract No. 960, as shown on
map reoorded in Book 17, Page 25, of Uaps, in the offioe of
the County Recorder of said County, desoribed as follows.

Coomenoing at the Northwest oorner of Traot No. 10726 as
shown on map reoorded in Book 185, Pages 31 and 32', of Ma:ps.
Reoords of said County; thence North 0001'30" roest along the
Easterly line of Holly Avenue as shown on map of Traot No.
3430, recorded in Book 42, Page 32, of Maps, Reoords of said
County, a distance of 330.76 feet to the true point of begin-
ning: thenoe North 81000' East along a line parallel to the
North line of said Traot No. 10726, a distanoe of 661.89 feet,
more or less, to the interseotion with the Northerly prolonga-
tion of the Easterly line of said Traot No. 10726, thenoe
North 0000'20" Y~est along said Northerly prolongation of said
Easterly line of Traot No. 10726 a distanoe of 96.35 feet,
more or less,to a point distant South 0000' East 2.59 feet from
the Southeast corner of the parcel of land oonveyed to the
Roman Catholio Bishop of Los Angeles and San Diego and
desoribed in deed reoorded in Book 13328, Page 110, Offioial
Reoords of said County; thence South 81000' '-est along a line
parallel to the South line of said paroel of land, a distanoe
of 661.20 feet, more or less, to the interseotion with said
Easterly line of Holly Avenue: thence South 0001'30" East
along said Easterly line of Holly Avenue 96.35 feet, more or
less, to the true point of beginning,

to permit the same to be used for the oonstruction. maintenanoe and operation
of a paroohial sohool and playground thereon. That after due notice as re-
quired by Ordinanoe No. 760 of the City of Aroadia, a public hearing on the
matter was held by and before the City Planning Commission on the 27th day of
July, 1954, at whioh tUne all interested persons were given full opportunity
to be heard and to present evidenoe. That thereupon said City Planning

Comm1l9sion did adopt its oertain Resolution No. 162 entitled "A RESOLUTION OF
THE CITY PLANNING COMMISSION OF THE CITY OF ARCADIA, CALIFORNIA, REC01lMENDING
THE GRANTING OF A fiONE VARIANCE AFFECTING CERTAIN REAL PROPERTY IN SAID CITY
TO PElrnIT THE CONSTRUCTION, MAINTENANCE AND OPERATION OF A PAROCHIAL SCHOOL
AND PLA'lGROUND THEREON", wherein and whereby it made oertain findings and recom-
mendations concerning the requested varianoe.

SECTION 2. That there were no prctests, oral or written, to the
granting of the varianoe requested. That the only person appearing cther than
in support of the applioation was the owner of adjacent property who requested
that adequate fencing be plaoed between his property and subject property.

SECTION 3. That for many years applioant has been the owner of exten-
sive properties looated at the southeast oorner of Huntington Place and Holly
Avenue and contiguous to subject property. That at said looation applioant has,
for many years, lawfully maintained and operated a church and parochial school
and faoilities incidental thereto. That said properties and improvements are
both extensive and expensive. That the tremendous growth of population in the
City of Aroadia has oaused a proportionate growth in the needs of and attendanoe
at applicant's facilities. That the very nature of applioant's activity re-
quires the location of all needed facilities at one general location. The fore-
going constitute exceptional conditions applioable to the intended use of the
subject property and do not apply generally to the class of uses in the same
vioinity and zcne.

SECTION 4. That the varianoe requested is necessary for the preserva-
tion and enjcyment of the substantial property right of the applicant possessed
by other property in the same vicinity and zone. That subject prcperty has no
access to public streets other than across other property of applicant already
improved for and irrevooably dedioated to the uses for whioh a variance is re-
quested herein. That applioant is engaged solely in religious, educational and
charitable purposes at adjacent looation and may use subjeot property only for
such purposes.

SECTION 5. That the granting of the varianoe requested will not be
materially detriment&.! to publio welfare, nor injurious to the property or 1m-
provemsnts in the vioinity and zone in whioh the subjeot property is looated.
On the oontrary, the publio welfare will better be served by aHawing the orderly
and proper planning and development of the faoilities required for applioant's
oooupation thereat. The requested varianoe will oreate no new oondition but
will permit the expansion of the present lawful uses of adjaoent properties in
a manner more benefioial to the vioinity and zone than it further expansion were
limited to the original properties previously used for suoh uses.
SECTION 6. That the granting of the varianoe requested will not ad-
versely affect the oomprehensive general plan, but, on the contrary, permits
oontinuation of present lawful and wholesome uses in an orderly and well
planned manner.

SECTION 7. That for the foregoing reason,l, the City Counoil of the
City of Aroadia does hereby grant a varianoe to permit the use of the property
hereinabove desoribed to be used for the purpose and in the manner stated in
petitioner's appiication on file herein, upon the oondition that a six-foot high
ohain link fenoe or masonry wall be oonstruoted along the southerly line of the
aforesaid property, oonneoting at its easterly end with the existing fenoe or
wall on adjaoent property of applioant~ that suoh fence or wall be oonstruoted
prior to the use of any portion of subjeot property for other than single family
residential purposes, and that suoh fenoe or wall be maintained at all times
that any portion of subjeot property is used for any of the purposes permitted
by the varianoe hereby granted.

SECTION 8. The City Clerk shall oertify to the adoption of this
Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted at 8>.
regular meeting of the City Council of the City of Aroadia, held on the 7th
day of September, 1954, by the affirmative vote of at least three Counoilmen,
