RESOLUTION NO. 2646
A RESOLUTION OF THE CITY COUNCn. OF THE CITY OF
ARCADIA, CALIFORNIA, DENYING AN APPLICATION OF
ARCADIA UNIFIED SCHOOL DISTRICT FOR A ZONE VARIANCE
TO PERl.lIT CERTAIN REAL PROPERTY IN SAID CITY TO BE
USED FOR THE CONSTRUCTION AND MAINTENANCE OF
AD~INISTRA:rION, SHOP AND r:AREHOUSE FACn.ITIES
THE CITY COUNCn. OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND,
DETElillINE AND RESOLVE AS FOLLa:~S:

SECTION 1. That there ws filed with the City Planning COlIDDission
of the City of Arcadia the petition d: the Aroadia Unified Sohool District,
as proposed purchaser, for a variance to permit the following described
property, to-wit:
Lots 6, 7, 8, the East 40 feet of Lot 9, and the ~est
90 feet of Lots 1 and 2, Tract No. 6074, as recorde~
in Book 67, page 83, of Maps, Official Records in the
office of the County Reoorder of Los Angela s County;
to be used for the erection and operation of school district administration

offices, district library, warehouses, bus garages and maintenance shops.
That after due notice as requirod by law, a publio hearing on the matter was
held by and befcre said City Planning Commission on August 24, 1964, which
hearing was duly continued to September 14, 1964, at which time all interested
persons were given full opportunity to be heard and to present evidence.
That said City Planning COlIDDission did thereupon adopt its certain Resolution
No. 170 entitled "A RESOLUTION OF THE CITY PLANNING COrJiUSSION OF THE CITY
OF ARCADIA, CALIFORNIA, RECOIllJENDING THE DENIAL OF THE REQUEST OF ARCADIA
UNIFIED SCHOOL DISTRICT FOR A VARIANCE AFFECTING PROFERTY ZONED R-l TO BE

USED FOR ADMINISTRATION, SHOP AND wAREHOUSE FACn.ITIES", wherein and whereby
it made certain findings and recommendations ooncerning the requested
variance.
SECTION 2. That there were over a hundred written protests and
numerous oral prctests to the granting of the requested variance, based to a
large extent upon the depreoiating effeot that narehouses, repair shops,
maintenanoe shops and bus terminals would have on the adjoining residential

~re~. That there are exoeptional ciroumstanoes regarding the intended use of
the property, emanating from the nature and duties of the applicant hereinl
honever, the very nature of the intended use, particularly the use of subject
property for warehouses, bus garages and maintenanoe shops, which are typically
industrial uses commonly relegated to industrial zones and specifically re-
quired to be in M-zonee under Ordinance No. 760 of the City of Arcadia, is so
disharmonious to the uses permitted in the area of subjeot property and so

detrimental to the properties and improvements in the surrounding residential
~rea as to require the denial of the requested variance. That the granting of
the requested variance will be materially injurious to the property and im-
provements located in such vicinity and zone, particularly by reason of the
faot that heavy industrial uses such as warehouses, bus terminals and mainte-
nanoe shops are utterly disharmonious to the single family residential nature
and use of the adjoining properties and will greatly impair the peace and quiet
of the neighboring community.

SECTION 3. That the granting of the variance requestsd is not neoss-
sary for the preservation and enjoyment of the substantial property rights of
the applioant for many reasons, inoluding the fact that applioant has the
power, under eminent domain, to aoquire at its reasonable market value any
property neoessary for the conduct of applicant's funotions.
SECTION 4. That the granting of the varianoe will adversely affeot
the comprehensive general plan in that it will permit and encourage the in-
stallation and maintenanoe of heavy industrial uses in an area developed and

zoned for single family residential units.
SEC'l'ION 6. That for the it'oregoing reasons, and for the reason that
the
hour requirements specified in Ordinanoe No. 760 for the granting of a vari-
ance have not been met, the petition of the Aroadia Unified Sohool Distriot
for a zone variance affeoting the property hereinabove desoribed should be
and the same is hereby denied \7ithout prejudioe to the consideration of any
application for the use of any portion of said premises for purely administra-

tive purposes only.

SECJ:ION 6. The City Clerk shall certify to the adoption of this
Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted at an adjourned
regular meeting of the City Counoil of the City of Arcadia, held on the
21st day of October ,1954~ by the affirmative vote of at least three
Councilmen, to-witt
