A RESOLtl'l'ION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA, CALIFORNIA, GRANTING A ~UESTED VARIANCE
TO PERMIT THE USE OF CERTAIN REAL PROPERTY m ZONE
R-1 TO BE USED FOR SPlOOIFIED COI+ImCIAL PlJRPOSl!3
THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES DETERMINE
AND RESOLVE AS FOLLOWS:
SEC'l'1VJ.~ 1. 'tnat were lias filed with the City Planning Colllll1seion the
petition of Ralph D. Stogsdill and Lulu P. Stogsdill, as owners, for a variance
to perm1t the following described property, to-wit:
The East 120 feet of Lot 23, Traot No. 6641, aDd Lot 25, Traot No.
664l, as per map reoorded in Book 126, Page 67, of Maps in the offioe
of the County Reoorder of Los Angeles County;
to be used for all uses presently perm1tted in Zone C-2, excepting those uses
specified in subsections 9, 10, 13, 32, 43, 58 aDd 64 of Part ~ of Section 9 of
Ordinance No. 7f:IJ of said City; that after notioe required by Ordinance No. 7f:IJ
of said City, a publio hearing vas duly held on the matter by and before said
. Plmming Commission on the 27th d8:y of July, 1954, at which time all interested
persona wre given a tull opportunity to be heard and to present evidence. '!'hat
said Planning COIlIIDission did thereupon pass, approve aDd adopt its certain
ResOlution No. 164, wherein and whereby it made certain findings aDd recommended
that the requested vsriance be denied. That the petitioners thereupon filed with

this CounoU an appeal trom said recommendation of the Pllll'ning Commission; and
that pursuant to said appeal, a public hearing thereon was by this Counoil set
for and held on the 5th d8:y of October , 1954.
SEXl'l'ION 2. That the City PJAnning Commission has heretofore recognized
the need for affording some reliet to borderline properties and to that end has
held publio hear1%l8l and has heretofore recOllllDllnded to the City Colmcil the 81118nd-
ment of Ordinance No. 7f:IJ by the establishment of four oommercial zonas. That
this City Council has held the required publio hearings for the p\l1'pOse 01' con-
sideri!Jg the recOIIIIIIllDdationa of said Caomission, pursuant to which it has made
determiJJatioll8 relative thereto and has ordered the ameDdment of Ordinance No. 7f:IJ
to establish four commercial zones.

SECTION 3. That this Council has heretofore, by its certain Resolution
No. 2319, .:;ranted relief to a portion of Lot 23 of said Tract No. 6642., adjacent
to subject property herein, to be used for all purposes permitted in Zone C-2
ex~ept those specified in Subsections 3, 5, 9, 10, 13, 25, 32, 43, 51, 58, 64 c:~
6G of Part A of Section 9 of said Ordinance No. 760. That the facts existing at
the time of the adoption of said Resolution No. 2319 in support of the findings
therein made remain substantially unchanged and the findings made therein t'lith
. reference to that portion of Lot 23 of said Tract No. 6641 therein described are
reaffirmed and readopted with reference to Lot 25 and the East 120 feet of Lot 23,
Tract No. 6641, the same as if herein again set forth in full.
SECTION 4. That for the foregoing reasons a zone variance should be and
is hereby granted to permit Lot 25 and the East 120 feet of Lot 23, Tract No. 664l,

to be used for all purposes presently permitted in Zone C-2 under Orcl:.nance No.
760, as the sarr.e is in effect as of the date of the adoption of this Resolution,
excepting only those uses specified in Subsections 3, 5, 9, 10, 13, 25, 32, 43, 51,
58, 8nd- 6/,:; of Part A of Section 9 of said Ordinance No. 760; and provided fur,.
ther, that the tenn "Filling station", as specified in Subsection 26 of Part A of
Section 9 of Ordinance No. 760, shall be deemed for the purposes of the variance
hereby granted, to rr.ean and to be limited to "A fillina station, containing not
more than six (6) pumps, one (1) grease rack and one (1) .-Iash rack, to supply
gasoline and oil to motor vehicles and provide minor aervicine and sales of /'lotor
vehicle accessories."

That the variance hereby granted is subject to the follouin~ continuing
conditions:

(1) That throuehout the time that any portion of the proparty
described in this section is used for any purpose permitted solely
by reason of this variance, the Southerly 105 feet of Lot 25 shall
be maintained and used solely for off-street parking of motor vehi-
cles and improved as required by Ordinance lro. 760 t-r.ith reference to
parking lot 6;
(2) That the property described in this section shall be s~bject to
all other applicable provisions of Ordinance No. 760 and other

ordinances of the City of Arcadia, and the violatin of any
provisions of =h ordinances shall constitute grounc\s for the
modification or cancellation of the variance hereby granted.
(3) That the variance hereby granted shall be subject to the
continuing power of the City to reclassify said property after
proceedings duly held.
SECTION 5. That for the purpose of clarification, Resolution No. 2319

entitled "A RESOLUTION OF TIlE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA,
DENTING THE ffiTITION FOR RECLASSIFICATION FROl1 ZONE R-l TO ZONE C-2 OF CERrAIN
REAL PROPERl'Y IN S,IID CITY, AlID GRANTING A VARIANCE FOR SffiCIFIED CC:~'IERCIAL
USES THEREOlI", adopted December 2, 1952, is hereby amended by adding thereto
Section }-A, the same to read as follO'l1s:
The term "filling station" as specified in Subsection 26, Part A of
Section 9 of Ordinance No. 760 of the City of Arcadia, and hereinafter included
as a use pennissible under the variance hereinabove granted, shall be deemed to
. mean and to be limited to "A filling station, containing not more than six (6)
pwnps, one (1) grec:.se rack and one (1) wash rack, to supply gasoline and oil to
motor vehicles and provide minor serviCing and sales of motor vehicle accessories."
SECTION 6. The City Clerk shall certify to the adoption of the above
Resolution.

meeting of the City Council of the City of Arcadia, held on the
