ARCADIA, CALIFORNIA, DENYING AN APPLICATION FOR
A VARIANCE TO PEIlM1T CtmAIN REAL PBOPERrY m
ZONE 11-1 TO BE USED AS A MULTIPLE DWELLING

srorIOH 1. '!'hat there was filed with the City PlAnning Commission
of the City of Arcadia the petition of Prances E. am Martin J. Stately, as CMl-
ers, for a VlU'iance to permit certain real property in Zone R-l described as
followel
That portion of Lot 4, Tract No. ~, as shown on map
recorded in Book 23, page 23, of Maps; and that portion
of Lot 43, Tract No. 11969, as shown on map recorded in
Book 259, page 36, of Maps, reoords of Los Angeles County,
lying within the northerly prolongation of the easterly
and westerly lines of Lot 38 of said Traot No. 11969,

to be used for a multiple dWll1ngl That atter due notice as required by lav,
. a public hearing on the matter was held by and before said City PlAnning Commis-
sion on September 14, 1954, at which time all intereeted persons were given tall
opportunity to be heard and to present evidence. That said City PlllIl!ling Com-
mission did thereupon adopt its certain Resolution No. 17.3, entitled "A RESOLU_
TION OF THE CITY PLANNING CCJ.lMISSION OF THE CITY OF ARCADIA, CAL:mlRNIA,
RreOMMENDmG THE DENIAL OF THE APPLICATION FOR A VARIANCE TO PERMl'l' CERrAIN REAL
PROPERTY IN ZONE 11-1 TO BE USED AS A MULTIPLE DWELLING", wherein and whereby it
made certain findings and rec""""'~~At1ons concerning the requested variance.

srorION 2. That subj ect property abuts property of en exceptionally
high type of developnent presently being rezoned from Zone R-l to Zone R-O.
That there were numerous protests to the granting of the requested variance by
the owners of property in the 1mmediate vioinity. That a similar petition wae
tiled with the Planning Commission on November 4, 1949, denied by said Commis-
sion on January 5, 1950, and denied by the City Council on January 17, 1950.
That no cirClUlllStances were found at that time to exist which would warrant or
justify the granting of the requested variance. That since that time the

circumstances have not changed so as to warrant ar justif'y the granting ot the
variance herein requssted but rather such changes as have occurred ID1litate
only f't:Irther against the granting ot the requested variance, one ot such changes
being the upgrading f'rom Zone B-1 to Zone R-O ot the adjacent properties.

SECTION 3. That the granting ot the variance requested is not
necessa17 tor the preservation ot substantial propert)" rights ot the applicant
tor the reason that the subject property is still as desirable and usable tar
the purposes tar which it is and tar years has been lloned as it vas at the time
and prior to the purohase thereot by applicant. That the granting of the re-
quested variance would injuriously affect adj acent properties in the 88IIl8
Vicinity and up to now in the same zone, particularly by reason of the1r excep-
tions.lly high type ot development and maintenance. That there are no exceptional
cir01lll1Btances applicable to the intended uee ot subj ect property, and no such
exceptional c1rClllll8tances applicable to the property itself, as vould compel
the granting of the requested variance.

SECTION 4. That tar the foregoing reasone, the petition ot Frances E.
and Martin J. Stately for a llone variance affecting the property hereinabove
described should be and the same is hereby denied.
SECTION 5. The City Clark shall certify to the adoption of this Reso-
lution.
I HEREBY cmrm that the foregoing Resolution was adopted at a regu.-
lar meeting of the City Council of the City ot ArcAn1~ held on the 3rd dllY
of Noveml!ler , 1954, by the a1'f'irmative vote of at least three CounciJJllen,
