That there was tiled with the City Ph""""8 CoIlmissiOl1 ot . the City ot Arcadia the peti tiOl1 ot Dr. J!)aanuel D1llce, as owner, tor a change ot mons classif'ication :tram Zone R-l to Zone R-3 or Zone C-l ot certain real prop.. erty described as tollows: That portion ot Lot 4, Tract No. 24!:fi, as shown on map re- corded in Book 23, page 23, ot Maps; and that portion ot Lot ~, Tract Bo. ll969, as shown on map recorded in Book 259, page 36, ot Maps, records ot Los Angeles County, all lyiDg within the northerly prolongation ot the s!18terly and westerly lines ot Lot 39 ot said Tract No. ll969. That atter dne notice as required by law, a public hearing on the matter was . held by and betore eaid City P"'''''''''g COJmDission on September 14, 1954, at which t1me all interested persons were given f'ull opportunity to be heard and to pre- sent evidence. That said City Planning Commission did thereupon adopt its certain Resolution No. 174, entitled 81 RESOLllTION OF THE cm PLANNIN:i CClWS- SION OF THE cm OF ARCADIA, CALIFORNIA, RECQolMElIDING THE DENIAL OF THE APPLICATION FOR 1 CHANGE OF ZONE FROM ZONE R-l TO ZONE R-3 OF CERTAIN REAL PROPERTY", wherein and whereby it made certain findings and recODmendatioDS concerning the reqnested variance. . SEX:TION 2. That subject property abuts property ot an exceptionaJ.ly high type ot development presently being rezoned :tram Zone R-l to Zone R-O. That there were numerous protests to the granting ot the requested change of zone by owners ot property in the 1mmediate vicinity. SEX:TION 3. That the granting of the requested change of zone is not necessary for the preservation of substantial property rights ot the applicant for the reason that the subject property is still as desirable and usable tor . - 2 - 2552 . the purposes for which it is end for ;years has been zoned as it was at the time and prior to the purchase thereof by applicant. That the granting ot 'the requested. change of zone would inJuriously ai'f'ect adjacent properties in the same vicinity and up to nO\l in the same zone, particularly by reason or their exceptionally high type ot developnent and mainteD8J1ce. That there ere no exceptional c1rC'lllllBtances applicable to the intended use or subject propert:y. and no such exceptional circumstances applicable to the property itself', as would warrant the granting or the requested change of zone. . SOOTION 5. That tor the foregoing reuOJ18, the petition. of Dr. Emanuel Duke tor a change ot zone classification ot the property hereinaboVe described should be and the same is hereby denied. . SOOTION 6. The City Clerk shall cert1t:y to the adoption of this Reso- lution.
