HomeMy WebLinkAbout2400 r ~ RESOLUTION NO. 2400 --J..1 ~11 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO I~~ROVE LA CADENA AVENUE AND OTHER STREETS BY THE PREPARING OF SUBGRADE AND GRADING NECESSARY FOR THE CONSTRUCTION OF CONCRETE CURBS AND GUTTERS, AND THE CONSTRUCTION OF CONCRETE CURBS AND GUTTERS AND APPURTENANT WORK THERETO WITHIN THE CITY OF ARCADIA, AND DETERMINING THAT BONDS SHALL BE ISSUED TO REPRESENT THE COST THEREFOR AND DECLARING THE WORK TO BE OF MORE THAN LOCAL OR ORDINARY PUBLIC BENEFIT AND THAT THE EXPENSE THEREOF SHALL BE ASSESSED UPON A DISTRICT. I.HEREAS, the City Council of the City of Arcadia, by Resolution No. 2398, adopted July 7, 1953, set a hearing, pursuant to 8eQtion 17 of Article XIII of the Constitution of the State of rCalifornia, for July 21, 1953, to determine whether or not the public : convenience and necessity require the improvement' of La Cadena Avenue ) between Fairview Avenue and Huntington Boulevard, St Joseph Street between First and Second Avenues, Third Avenue between Huntington :~. Boulevard and the north line of Tract 6860, Lucile Street between First Avenue and Santa Anita Avenue, Walnut Avenue between Baldwin " I r I I Avenue and Station 12+00, and Walnut Avenue between Station 12tOO and Holly Avenue, all in the City of Arcadia, by the preparing of subgrade and grading necessary for the construction of concrete curbs ~nd gutters , and the construction of concrete curbs and gutters and appurtenant work thereto; and .1 I WHEREAS, on said date said hearing was held and said City Council by Resolution No. 2399 , adopted by a four-fifths vote on July 21, 1953, determined that the public convenience and necessity require the said improvement of La Cadena Avenue between Fairview Avenue and Huntington Boulevard, St Joseph Street between First and Second Avenues, Third Avenue between Huntington Boulevard and the north line of Tract 6860, Lucile Street between First Avenue and Santa Anita Avenue, Walnut Avenue between Baldwin Avenue and Station 12+00, . 1 \. \ : INOEXeo d-v<>() . . and Walnut Avenue between Station 12+00 and Holly Avenue, all in the City of Arcadia, by the preparing of sub grade and grading necessary for the construction of concrete curbs and gutters, and the construc- tion of concrete curbs and gutters and'appurtenant work thereto. NOW, THE~EFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require and it is the intention of the City Council of the City of Arcadia to order the following work to be done, to wit: The improvement of La Cadena Avenue betw'een Fairview Avenue and Huntington Boulevard, St Joseph Street between First and Second Avenues, Third Avenue between Huntington Boulevard and the north line of Tract 6$60, Lucile Street between First Avenue and Santa Anita Avenue, Walnut Avenue between Baldwin Avenue and Station 12+00, and Walnut Avenue between Station 12+00 and Holly Avenue, all in the City of Arcadia, by the preparing . of'subgr.ade and grading necessary for the construction of concrete curbs and gutters, and the construction of concrete curbs and gutters and appurtenant work thereto, all within the City of Arcadia. The estimated cost of the improvement is $20,462.43. All of the foregoing work shall be done in accordance with the Profile and Improvement Plan Job No. 204 and any supplemental drawings mentioned thereon, which said Profile and Improvement Plan was adopted by the City Council on July 7, 1953, by Resolution No. 2396, and is on file in the office of the City Engineer of said City . and in accordance with specifications entitled "Specifications and Contract Documents for Improvement of La Cadena Avenue and Other Streets" as adopted by the City Council of said City on the 7th day of July, 1953, by Resolution No. 2396. SECTION 2. That said proposed work or improvement in the opinion of the City Council of the City of Arcadia is of more than local or ordinary public benefit, and said Council hereby proposes -2- ~~ao . . . . . that the district in the City of Arcadia to be benefited by said work or improvement and to be assessed to pay the cost and expense thereof, is shown upon a certain plan or map approved by the City Council on July 7,1953, by Resolution No. 2397, indicating the exterior boundary thereof, which said plan or map is on file in the office of the City Engineer and is marked No. W-64. Said plan or map hereby is referred to 'and shall govern for all details as to the extent of said assessment district. Said assess- ment district includes in general the lots and parcels of land abutting upon or contiguous to said hereinabove described streets and avenues, but reference hereby is made to said plan or map for all details as to the extent of said assessment district and for any variation between the last mentioned general description and the extent of said assess- ment district as shown on said plan or map. All public streets or alleys, or portions thereof, hereby are excepted from said district. SECTION 3. That serial bonds bearing interest at the rate of 6% per annum shall be issued to represent each assessment of $25.00 or more remaining unpaid for 30 days after the date of the warrant. Said serial bonds shall extend over a period ending 9 years from the second day of January next succeeding the next October 15th fol101ring their date. Payments on the principal of unpaid assessments and interest shall be made by property owners to the City Treasurer, and the sums shall be disbursed by him or as provided in the "Improvement Act of 1911" hereinafter referred to. SECTION 4. Notice hereby is given that on Tuesday, the lSth day of August, 1953, at the hour of S:OO o'clock p.m., in the Council Chambers in the City Hall of said City of Arcadia, situated at 240 West Huntington Drive, in said City, any and all persons having any objections to the proposed work or improvement may appear before the City Council and show cause why the said proposed work or improvement -3- .2. $1'0 0 . . . . . should not be carried out in accordance with said Resolution of Intention. SECTION 5. The Superintendent of Streets immediately shall cause to be conspicuously posted along the line of said contemplated work or improvement and also along all the open streets within the said district, notice of the passage of this Resolution of Intention in the manner and form prescribed by law. The City Clerk hereby is directed to mail notices, in the manner and form prescribed by law, of the adoption of this resolution to all persons owning real property in the hereinbefore described assessment district, whose names and addresses appear on the last equalized assessment roll for city taxes or as known to the City Clerk. SECTION 6. The City Council of the City of Arcadia in making the improvement and in doing the work prescribed herein, elects to pro- ceed under and in accordance with the provisions of the "Improvement Act of 1911," being Division 7 of the Streets and Highways Code of the State of California. SECTION 7. The City Clerk shall certify to the adoption of this Resolution of Intention and shall cause the same to be published twice in the Arcadia Bulletin, a newspaper published and circulated in the City of Arcadia, the first of which publication shall be not less than 10 days prior to August 1$, 1953. r HEREBY CERTIFY that the foregoing resolution was adopted at a regular meeting of the City Council of the City of Arcadia, held on the 21st day of July, 1953, by the following vote: AYES: Councilmen Dow, Hulse, Kennett, Nottingham and Schmockel NOES: Councilmen None ABSENT: Councilmen None /~-d City of Arcadia -4- off/ad .
