RESOLUTION No.i403 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, SETTING A HEARING FOR THE PURPOSE OF DET~rrNING WHETHER OR NOT THE PUBLIC CONVENIENCE AND NECESSITY REQUIRE THE IPWROVE- MENT OF SANTA CLARA STREET AND CERTAIN ALLEYS, ALL \ifITHIN THE CITY OF ARCADIA. . WHEREAS, Section 17 of Article XIII of the Constitution of the State of California provides that the debt limitation and majority protest provisions of said section shall not apply if, after the giving of such reasonable notice by publication and posting and the holding of such public hearing as the City Council of the City of Arcadia shall have prescribed, said council by no less than a four-fifths vote of all members thereof, finds and determines that the public convenience and necessity require the improvement proposed to be made; and WHEREAS, Section 2804 of the Streets and Highways Code of the State of California provides that the "Special Assessment Investi- gation, Limitation and Majority Protest Act of 1931" shall not apply to any proceeding otherwise subject thereto when said improvement pro- ceeding is by a charter city and said city has complied with the provi- sions of Section 1'7 of Article XIII of the Constitution of the State of . California; and \fflEREAS, the City of Arcadia is a charter city of the State of California; NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: . SECTION 1. That said City Council proposes to initiate proceedings for the improvement of Santa Clara Street between First Avenue and Second Avenue, Santa Clara Street from Santa Anita Avenue to First Avenue, alley north of Foothill Boulevard from Oakwood Drive to First Avenue, alley north of St. Joseph Street from First Avenue to Station 3+81.69, alley north of Fano Street from First Avenue to . JNDEXED .2.. Yo '0 . . Second Avenue, all within the City of Arcadia, by the grading, preparing subgrade, paving, and the construction of concrete curbs, gutters and aprons and appurtenant work thereto. The nature, location, and extent of the proposed improvement and the district to be assessed for the cost and expenses thereof are as shown respectively on the plan and profile No. 210, adopted by the City Council of the City of Arcadia by Resolution No. 240~ on July 21, 1953, and assessment district map No. W-65, adopted by said City Council by Resolution No. 2401, on July 21, 1953, and on file in the office of the City Engineer and the office of the City Clerk of said city and in accordance with specifi- cation entitled "Specifications and Contract Documents for Improvement of Santa Clara Street, first alley north of Foothill Boulevard, and other alleys," which said specification duly was adopted by said City Council by Resolution No. 240a on the 21st day of July, 1953, which said plan and profile, assessment district map and specification now are on file in the office of the City Engineer and of the City Clerk of said city, to which said plan and profile, assessment district map and specifications, reference is made for all particulars relative thereto. . . SECTION 2. That the total estimated cost of the proposed improvement is i13,976.lS. SECTION 3. That said improvement shall be conducted under the Improvement Act 'of 1911, which is Division 7 of the Streets and Highways Code of the State of California. SECTION 4. That notice hereby is given that on Tuesday, the 4th day of August, 1953, at 8:00 o'clock p.m., in the Council Chamber, located in the City Hall of said City, there shall be a pub- lic hearing before said City Council for the purpose of determining whether the public convenience and necessity require the above described improwement. . -2- j~3 . SECTION 5. That the City Clerk shall give notice of the hearing by posting a copy of this resolution in the manner prescribed by Section 5065 of the Streets and Highways Code and by publication as hereinafter provided. Any person interested may make protest against the proposed improvement in writing filed with the City Clerk at any time not later than the hour set for the hearing in the manner . provided by Section 5220 of the Streets and Highways Code. SECTION 6. That the City Clerk hereby is directed to publish this resolution in the Arcadia Bulletin on two successive dates, the first publication to be made not less than ten (10) days prior to the date of the above public hearing. SECTION 7. The City Clerk shall certify to the adoption of this resolution and thenceforth and thereafter the same shall be in full force and effect.
