RESOLUTION NO.2~37 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING THE BUSINESS OF MANUFACTURING INDUSTRIAL PACKINGS TO BE A USE PERMISSIBLE IN ZONE M-l UNDER ORDINANCE NO. 760 OF THE CITY OF ARCADIA. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES FIND, DETERMINE AND RESOLVE AS FOLLOWS: SECTION 1. That under the provisions of Ordinance No.760 of the City of Arcadia containing the itemization of specific uses permitted in various zones thereby established, there is no speCific . classification for the manufacture of industrial packingsj that Searles Leather' and Packing Company has requested information concern- ing the proper zone for the manufacture of leather, rubber and plastic packings. SECTION 2. That Section 15 of Ordinance No.760 provides in part that if any use "is for any reason omitted from the lists of those specified as permissible in each of the various zones, it shal1 be the duty of the City Planning Commission to ascertain all pertinent facts concerning said use and by resolution of recor& set . forth its findings and such resolutions shall be referred to the City Council, and if approved by the City Council thereafter such inter- pretation shall govern." SECTION 3. That Section 11, sub-section A 46 of Ordinance No.760 prOVides that in Zone M-1 the following use among others is per- missible: Other kinds of manufacture, processing or treatment of products other than those which may be obnoxious or offensive by reason of emission of odor, dust, smoke, gas, noise or other similar . characteristics, including hazards, provided that the determination of the character of any use as defined in this item shall be arrived at as set forth :Ln Section 15, Paragraph A. Use, subparagraph 1. General, item "a". SECTION 4. That the Planning Commission of the City of Arcadia has investigated the matter and ascertained the pertinent facts, and has made its findings and recommendations by and under its Resolution No.l22 passed, approved and adopted September 8, 1953, . wherein its findings and recommendations that the business of -1- {l\tO ,,,0 ~'I'8 7 . leather or rubbe:[' by the use of small presses and lathes, substantially as represented in the letter of August 25, 1953, samples and brochure submitted b~ Searles Leather and Packing Company in this matter and made a part of the records and files of the Planning Collllllission here- in, be deemed a use permissible in Zone M-l ~der Section ll-a of Ordinance No.760, upon the following conditions: That nl) leather tanning be performed or permitted in Zone M-l; that neither the rubber o~ plastic components be itself manu- factured in Zone M-l; that said business create or cause no obnoxious or offensive OdOl~S, smoke, gas, noise or other similar characteristics or hazards. SECTIOn 5. In accordance with the foregoing, this Council hereby finds, determines and resolves that the business of manufactur- ~g small industl'ial packing rings and discs of plastic, leather or rubber by the use of smaIl presses and lathes, substantially as represented in the letter of August 25, 1953, samples and brochure submitted by Seal'les Leather and Packing Company in this matter and made a part of the records and flles of the Planning Commission, shall be and the same is hereby classified as a use permissible in Zone M-l under Section II of Ordinance No.760 of the City of Arcadia, upon the folloWir:lg conditions: That rllO leather tanning be performed or permitted in Zone M-l; that neither' the rubber or plastic components be itself manu- factured in Zope M-l; that said business create or cause no obnoxious or offensive odors, smoke, gas, noise or other similar characteristics or hazards. . . . . The Council hereby expressly reserves the right to further define and limit the business hereinabove described as further investigation or hearings may indicate the necessity so to do, and all persons engaged in business under the authority here- of shall be at all times subject to any definations or limitations as may hereafter be thus imposed. SECTION 6. The City Clerk shall certify to the adoption of this Resolution. -2- RS'i37 .
