A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF ARCADIA, CALIFORNIA, DENYING THE REQUEST FOR
A VARIANCE TO PEID1IT THE CONSTRUCTION OF,A THIRD
DWELLING ON A LOT IN ZONE R-I.
WHEREAS, there was flled with the City Planning Commission
the petition of Harry H. and Edna M. Vogt, requesting a zone variance

affecting the Westerly 220.92 feet of the Southerly 92.5 feet of
the Northerly 185 feet of Lot 60, Tract No.808. as shown on map re-
corded in Book 16, Pages 82 and 83 of Maps in the office of the
County Recorder of Los Angeles County, to permit the use of said
property in Zon,~ R-l for the construction and malntenance of a
third single family dwelllng; and
WHEREAS, after due notice as required by law, a public hearing
on the matter was held by and before this Commission on on October
13, 1953, at which tlme all int~rested persons were given full oppor-
tunity to be heard and to present evidence; and

WHEREAS, on November 10, 1953, said Commi6sion passed, approv-
ed and adopted tts certain Resolution No.l29 wherein and whereby
. it made its findings relative to the requested variance and recom-
mended to this Council the requested variance be denied.
NOW, THEREFORE, th~ City Council of the City of Arcadia does
hereby find, determine and resolve as follows:
SECTION 1. That subject property lacks 2072 square feet of the
.
area required for a third single family dwelling in Zone R-l. That
the requested third dwelling would necessarily be constructed un-
reasonably close to the playground on the adjacent school property.
That such a plan does not conform to sound planning principles.
That there are no exceptional or extraordinary circumstances or
conditions applicable to the property involved or to the intended
use of the prope.rty that do not apply generally to the property or
class of uses ln the same vicinity or zone. That the granting of
the variance is not necessary for the presdrvation or enjoyment of
substantial property rights of the applicant possessed by other
property in the ;Bame vicinity or zoae.

SECTION 2. That for the foregoing reasons the request of
Harry H. and Edrul M. Vogt for a variance to permit thE use of
subject property in Zone R-l for the construction and maintenance

of a third single famlly dwelling be and the same is hereby denied.
SECTION 3. The City Clerk shall certify to the adoption
of th1s Resolut:l,on.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of theCity Counc11 held on the 1st day of
December, 1953, by the affirmative vote ot the following Couno1lmen,
to-wit:
