A RESOLUTION OF TirE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORIUA, DENYING THE PETITION FO,l THE EXTENSION AND ENLARGEMENT OF AN EXIST- ING VARIANCE AFFECTING CERTAIN REAL PROPERTY IN SAID CITY. WHEREAS, there was filed with the City Planning Commission the petition of Herbert Kal11woda as owner, requesting a zone variance affecting the Westerly lOO feet of that portion of Lot 69, Santa Anita Colony per map recorded in Book 42, Page 87, Mis- cellaneous Records of Los Angeles County as more particularly des- cribed in said application, to permit the extension of a variance heretofore gra:nted for an add1tional five year period and the ex- tension of said variance as granted ana thus extended to an addition- al 25 feet of adjacent property; and WHEREAS, a:rter due notice as required by the provisions of Ordin- ance No.760 of the City of ArcadIa a public hearing was held on the matter by and before this Commission on the 25th day of August 1953, which hearing was at the request of applicant regularly continued . to September 8, 1953. at which times all interested persons were . . given an opportunity to be heard and to present evidence. WHEREAS, on September 22, 1953, said Commission passed, approved and adopted itl3 certain ReBdution No.123 wherein and whereby it made its findil1gs relative to the requested variance and recommended to this Council the requested variance be denied. NOW, THEREFORE, the City Council of the City or Arcadia does hereby find, determine and resolve as fol10W6: SECTION l. That there were letters of protest filed by five owners of adjolning properties and a petition bearing twelve sig- natures of adjoining owners and residents within the immediate vicinity, all I)rotesting the granting of any portion of the variance requested and lltatlng their reason therefor. SECTION 2. The variance affecting subject property heretofore originally granted and as subsequently extended, will not expire until March 7, 1955. A request for a sinular extension was re- commended for denial by said City Planning Commission on September 23, 1952, and was denied by this City Ceuncil on October 2l, 1952, . -1- 02.'/6-0- . pursuant to Resolution ro.2307 for the reason there was no apparent need tor further extension of the existing variance and that the further extensj.on of the variance would have a retarding affect upon the development of unimproved adjoining properties; that the extension was projected so far into the future as to make the inte- gration of business conditions on subject and adjoining properties . difficult if not impossible; that each of said reasons are indivi- dually and collectively applicable at this time. That the request . for the extension of the variance to additional property 1s totally unnecessary foX' the protection of property rights of the applicant. That the letters and petitions of protest reflect the retardent effect of applicant's present business and the reasons tor not extending the same so far into the future; that the owner of the largest single parcel of adjacent property has for some time planned extensive light commercial development thereof; that the previous request for ad- ditional time wa~enied as being prematire; that in the light of present plans for the development of adjacent properties the pre- . . sent requested time extension is even more premature. That the evidence presented indicates that the restrictions imposed by the present variance are not being complied with. That the requested variance will definitely be detrimental to adjacent properties and improvements thereon and injurious and detrimental to the publiC welfare, health and convenience. That the property is presently properly zoned and fully adequate provision haa been made for all conditions that may be peculiar to 8ubject property. SECTION 3. That for each of the foregoing reasons the request of Herbert Kalliwoda for extension and enlargement of the existing variance affecting subject property be and the same is hereby denied. SECTION 4. The City Clerk shall certify to the adoption of this Resolution.
