IECIARING ITS INTENTION TO FORM A LIGHl'IllG MAINTENANCE ill STRICT , vffiICH DISTRICT IS TO PAY THE cosr AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHl'ING SYSTEM ON PORTIONS OF ALTERN STREET, CORNELL DRIVE, IEDA LANE, IENI'A LANE, MAGNA VISTA AVENUE, l>lARENDALE lANE. NEWMAN AVENUE, OAKYlOOD AVENUE, ONTARE ROAD, PAMEIA DRIVE, LINOON WAY, ROSEMARIE DRIVE, SAN CARIDS ROAD, SANTA ANITA AVENUE. WILSON AVENUE. l-lINOOOR ROAD, YORKS!{(RE DRIVE, BAIlIIWIN AVENUE, DUARTE ROAD, HUNTINGTON DRIVE AND SUNSET BOUIEVARD IN SAID CITY, AND FIXING A TIME AND PLACE FOR fEARING OBJECT.. IONS TO THE FORMATIOIl OF SAID DISTRICT OR TO THE EXTENI' THEREOF. THE CITY COUNCIL OF 7HE CITY OF ARCADIA DOES RESOLVE AS FOLIDWS:: . SECTION 1. That. the public interest and convenience require and that it is the intention of the City Council of the City of Arcadia to form a lighting main- tenance district to be known as Lighting Maintenance District No.6, for too purpose of assessing said district to pay a portion of the cost and expenses of maintaining and operating a street lighting system consisting of seventy-ceven (77) 2500 lumen lamps in Zone I of said District on portions of Altern Street, Cornell Drive, Lads Lane, Lenta Lane. Magna Vista Avenue, Marendale Lane, Newman Avenue, Oakwood Avenue, Ontal'a Road, Pamela Drive, Lyndon Way, Rosemarie Drive, San Carlos Road, Santa Anita Avenue, rlilson Avenue, Windsor Road, Yorkshire Drive, Baldwin . Avenue, Duarte Road. Huntington Drive, and Sunset Boulevard. . SECTION 2. The Hems of expense of maintenance and operation of the said lighting system to be furnished and to be assessed in part against the lands within the district, (exclusi,ve of improvements), are electric power, repairs. replace- ments, maintenance, labor, materials, engineering, printing and advertising. The estimated amount of electric power necessary for said system for each year in Zone 1 of said District is forty-four thousand eight hundred and fourteen (44,814) Kilowatt hours and the estilnated cost of said electric power for the first year of maintenance and operation is the sum of $960.00. . The estimated amount of electric power necessary for said system in Zone 2 of said District is 95,264 Kilowatt hours, and the estimated cost of said electric power for the first year of maintenance and operation is $2,125.00. The estimated cost, of all items of maintanance and operation of said system for the first year is a,s follows: Zone I, $3.575.00; Zone 2, $6,468.00. SECTION 3. Thet the said contemplated maintenance and operation of said :1-",9 ,," ,~ . .,<SI~7 . . . . . lighting system in the opinion of the City Council of the City of Arcadia is of more than local or ordinary public benefit and said City Council hereby makes the expense of. said maintenance and operation, exx::lusive of the amount to be paid by said Cit~' as stated in Section 5 hereof, chargeable upon a district, which district said City Council hereby declares to be the district benefited by said maintenance and operation and to be assessed to pay the cost and ex- penses thereof; which said district shall, in general, include all those lots fronting on said portions of said streets. A plat or map of said District indicating by a boundary line the extent of the lands included in the proposed district, and indicating by symbol showing the type of lighting the portion in Zone I and Zone 2, was approved and adopted by the City Council of :,aid City of Arcadia, and is on file in the office of the City Clerk of the City of Arcadia. Reference is hereby made to said plat or map for further, full and complete description of said Lighting MainteIl8llCe District No. 6, and said map so on file shall govern for all details as to the extent of such district. SECTION 4. That said maintenance and operation shall be furnished for said system for a period from the date of the formation of said district to and including June 30, 1958. SECTION 5. The City Council of the City of Arcadia hereby orders that fifty (50%) per cent of the total maintenance and operation cost and expenses of said system in Zone 1 and forty (40%) per cent of the total maintenance and operation cost in Zone 2 be paid out of the treasury of said City from the general fund of said City. SECTION 6. Notice is hereby given that on Tuesday, the 16th day of f' < ' February , 1954, at the hour of 8:00 o'clock P.M. of said day, in the Council Chambers of said City Council of Said City of Arcadia, in the City Hall of said City, any and all persons owning land or having any interest in lands within the district liable to be assessed for the e:xpenses of said maintenance and operation or any portion thereof, may be heard and any of said persons may present any objections that they IIl(IY have by protest. SECTION 7. All the proceedings for the aforesaid maintenance and operation of said system shall be had and taken under and in accordance with the provisions of an act of the Legislature of the State of California known and designated as the Municipal Lighting MainteIl8llCe District Act of 1927, being Division 14, Part .;.. I/e;. ., . :3 of the Streets and Highways Code of the State of California. SECTION 8. The Superintendent of Streets shall post or cause to be posted. copies of this Resolution headed "Notice of formation of lighting main- tenance district" along all open streets within said district liable to be assessed, in the manner and form required by law. SECTION 9. The City Clerk shall certify to the adoption of this Resolution and shall cause the sane to be published twice in the Arcadia Bulletin, a newspaper of general circulation published and circulated in the City of Arcadia and hereby designated for that purpose. . adjourned I HEREBY CERTIFY that the foregoing Resolution was adopted at lIv'egular meeting of the City Council of the City of Arcadia, held on the 16th day of February to wit: , 1954, by the affirmative vote of at least three CounCilmen, AlES: Councilmen Dow, Hulse, Kennett and Schmocker NOES: None ABSENT : Councilman Nottingham . ~~~ .City lerk of the City of Arcadia SIGNED AND APPROVED this 6th day of February , 1954. .
