A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS INTENTION TO FORM A LIGHTING MAINTENANCE DISTRICT, WHICH DIS- TRICT IS TO PAY THE COST AND EXPENSES FOR THE MAINTENANCE AND OPERATION OF A STREET LIGHTING SYSTEM NOW INSTALLED ON PORTIONS OF SANTA ANITA AVENUE, OAKWOOD DRIVE, HIGHLAND OAKS DRIVE AND ORANGE GROVE AVENUE IN SAID CITY, AND FIXING A TIME AND PLACE FOR HEARING OBJECTIONS TO THE FORMA'rION OF SAID DISTRICT OR TO THE EXTENT THEREOF. THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES RESOL VB AS FOLLOWS: . SECTION 1. That the public interest and convenience re- qUire and that ~t is the intention of the City Council of the City of Arcadia to form a lighting maintenance district to be known as Lighting Maintenance District No.7, for the purpose of assessing said district tel pay a portion of the cost and expenses of main- taining and operating a street lighting system consisting of thirty- two (32) 2500 ltmen lamps now installed on portions of Santa Anita Avenue, Oakwood Drive, Highland Oaks Drive and Orange Grove Avenue. SECTION 2. The i tams of expense of maintenance and operation of the said lighting system to be furnished and to be assessed in part against the lands within the district (eXClusive of improvements), are electric power, repairs, replacements, maintenance, labor, materials, engineering, printing and advertis- . ing, supplying of steel poles in lieu of the standard wood poles. That the estimated cost of electric power necessary for said system for the first year of maintenance and operation is the sum of . $887.04. That the additional cost of supplying steel poles in lieu of wood poles for the first year of maintenance and operation is the sum of $1760.00. That the estimated cost of all other items of maintenance and operation of said system for the first year is . $38.00 " - 1 - ,:}.Y7f? ,/ ~ . . SECTION 3. That the said contemplated maintenance and operation of sllid lighting system in the opinion of the City Council of the City of Arcadia is of more than local or ordinary public benefit and said City Council hereby makes the expense of said maintenance and operation, exclusive of the amount to be paid by said City as stated in Section 5 hereof, chargeable upon a district, which district said City Council hereby declares to be the district benefited by said maintenance and operation and to be assessed to pay the cost and expenses thereof;. which said dis- trict shall, in general, include all those lots fronting on said portions of said streets. A plat or map of said District indicating by a boundary line the extent of the lands included in the proposed district was approved and adopted by Resolution No. 2477 of the City Council of said City of Arcadia, and is on file in the office of the City Clerk of the City of Arcadia. Reference is hereby made to said plat or map for further, full and complete description of said Lighting Maintenance District No.7, and said map so on file shall govern for all details as to the extent of such district. . SECTION 4. That said maintenance and operation shall be furnished for said system for a periOd of five years from the date of the formation of said district. . SECTION 5. The City Council of the City of Arcadia hereby orders that fifty per cent (50%) of the total maintenance and operation costs and expenses of said system, other than the additional cost of supplying steel poles in lieu of wood poles amounting to $1760.00, be paid out of the treasury of the said City from the general fund of said city. SECTION 6. Notice is hereby given that on Tuesday, the 18th day of May" ; 1954, at the hour of 8:00 0' clock P.M. of said day, in the Coundl Chambers of said City Council of said City of . - 2 - J. 41 r$ . Arcadia, in the City Hall of said City, any and all persons owning land or having any interest in lands within the district liable to be assessed for the expenses of said maintenance and operation of any portion thel~eof, may be heard and any of said persons may present any objections t;hat they may have by protest. SECTION 7. All the proceedings for the aforesai d mainte- nance and operation of said system shall be had and taken under and . in accordance with the provisions of an act of the Legislature of the state of California known and designated as the Municipal Lighting Maintenance District Act of 1927, being Division 14, Part 3 of the Streets and Highways Code of the State of California. SECTION 8. The Superintendent of Streets shall post or cause to be posted, copies of this Resolution headed "Notice of for- mation of lighting maintenance district" along all open streets within said district liable to be assessed, in the manner and form required . by law. , SECTION 9. The City Clerk shall certify to the adoption of this Resolution and shall cause the, same to be published twice in the ,Arcadia Bulletin,. a newspaper of general circulation published and circulated in the City of Arcadia and hereby designated for that pur- pose. .
