RESOLUTION NO. 2490 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, PROTESTING ISSUANCE OF "ON SALE GENERAL" LIQUOR LICENSE AND REQUESTING A LOCAL HEARING ON THE APPLICATION THEREFOR THE crry COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETERMINE AND RESOLVE AS FOLLC7.'lS: . SECTION I. That an application for an "on sale general" liquor license has heretofore been made to the State Board of Eq~alization for the premises located at 17 - 23 Morlan Place in the City of Arcadia, County of Los Angeles, State of California. . That the premise:s located at 17 - 23 Morlan Place, Arcadia, Cali- fornia, are known as the Arcadia Bowling Courts. That the said Arcadia BOWling Courts have been in operation at said location for more than four y.~ars. That the said Arcadia Bouling' Courts have through such period of time been conducted in a generally satis- factory manner w:lthout the possession of an "on sale general" liquor license and wi thout the sale of such beverages as would be permitted by such a license. SECTION 2. That the Arcadia BOI'Il1ng Courts consist of bowling alleys, pool tables, billiard tables, snooker tables and an eating establishment. That bouling, pool, billiards and snooker are wholllSOm.e recreational activities when conducted in . proper surroundings, under proper conditions and under adequate supervision. That the Arcadia BOI'Iling Courts are in fact a recre- ational center. That the Arcadia Bowling Courts have encouraged the use of its facilities by the younger people of the community of Arcadia as well as by the adults of this city. That the Arcadia BOWling Courts have in fact beome a center of attraction for and have been frequented in large numbers by the youth of the City of Arcadia. - 1 - .-2)17'0 . . SECTION 3. That the true party in interest in the application for an "'on sale general" liquor license at 17 - 23 Morlan Place, A;['cadia, California, is not the person who has heretofore owned and operated the Arcadia Bocrling Courts in excess of four years lllst past as aforesaid, and who may be said to have a large investml~nt in such business, but the true party in inter- est is the proposed purchaser of the property and business known . as the Arcadia Bowling Courts. That the proposed purchase and sale of the business and property knOml as the Arcadia Bowling Courts is still in escrow and the consummation thereof is contin- gent upon the obtaining of the requested "on sale general" liquor license. That the immediate sale of such business and premises' upon the issuan<:e of the requested "on sale general" license, in the opinion of t;he City Council, violates the spirit if not the letter of the conclusions arrived at during the recent special sossion of the California State Legislature with reference to the matter of alchollc beverage control. . . SECTION 4. That the issuance of the requested "on sale general" liquor license at 17 - 23 Morlan Place, Arcadia, Cali- fornia, has already been vigorously protested by the Arcadia P.T.A. Council, by the Arcadia Coordinating Council representing approxi- mately sixty service clubs, associations, youth character, church and veterans' groups, and by the Holly Avenue Parent-Teacher Association. That this Council believes that numerous other church and youth groups will, if given reasonable opportunity, voice con- certed and serious objection' to the issuance of the requested "on sale general" liquor license at 17 - 23 Morlan Place, Arcadia, California. . SECTION 5. That the City Council of the City of Arcadia, as the elected representatives of a community in excess of 33,000 people, finds and determines in the light of the foregoing facts that the issuanc'9 of an "on sale general" liquor license for the - 2 - ..t f/'1CJ . premises located at 17 - 23 Morlan Place, Arcadia, California, and known as the Arcadia Bowling Courts, will be injurious to the welfare and morllls of the inhabitants of the City of Arcadia and particularly of the youth of this community. That the denial of the requested pElrmit is proper and will violate no vested rights of the present or future owners of the premises inVOlved. That the . City of Arcadia does hereby, by and through its duly elected offi- cials, respeotfully, but none the less firmly, protest the granting of the requested. "on sale general" liquor license to the premises known as 17 - 23 Morlan Place, Arcadia, California. The City Council of the City of Arcadia does hereby formally request that at least one public hearing before the State Board of Equalization in the matter of the application for an "on sale general" license for the premises at 17 - 23 Morlan Place, Arcadia, California, be . held in the City of Arcadia, California, so that the residents of this community and particularly the civic organizations interested in the youth of 'this community may, as the persons most vitally interested, be afforded a ready means of presenting their protests and their eviden'~e in support of such protests, and to this end the City of Arcadia does hereby offer to make available for the purpose of such a hearing, at any time when the same is not already City irrevocably scheduled for other official meetings,_ the Arcadia/CoUn- cil' Chambers, located in the Arcadia City Hall, 240 West Huntington Drive, Arcadia, California. . SECTION 6. The City Clerk shall certify to the adoption of this Resolution and shalloause a copy of the same to be forwarded to the State Board of Equalization of the State of California and to V. E. Hanson, Liquor Administrator, State Board of EqUalization, 357 south Hill Street, Los Angeles, California,and to the representatives of this comm).1n1t~' in the California State Legislature. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meeting of the City Council of the City of . - 3 - .2.Y'1o .
