RESOLUTION NO. z49$ A RESOLtrrION OF THE CITY COUNCIL OF THE CITy OF ARCADIA, CALIFORNIA, GRANl'ING AN EXTENSION OF AN EXIS7ING VARIANCE FOR LIGHI' MANUFACTURING PURPOSE:S THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, DOES HEREBY DETER- MINE AND RESOLVE AS FOLLCMS: . SECTION 1. That there was filed with the City Planning Coll1ll1ission the application of the :ndustrial Brush Company, Inc. for the extension of an exist- ing variance to permit the further expansion of light manufacturing uses on property now subjeci; to a variance for off-street vehicle parldng in connection with the existing 1;"cght manufacturing business, and to use other nearby property for vehicle off-strElet parldng in connection with such light manufacturing busi- ness. That after due notice as required by law, a public hearing was held by and before said City Planning Coll1ll1ission on March 9, 1954, at which time all persons interested Were given a :f'ull opportunity to be heard and to present evidence. . That thereupon the City Planning Coll1ll1ission did adopt its certain Resolution No. 147 on April 13, 1954, wherein and whereby certain findings were made and a reso~ lution made that the requested variance should be granted. . SECT10N 2. That there were no protests, oral or l'lritten, to the granting of the requested variance;: that on August $, 19$2, this Council, by and under' its Resolution No. 2271, made certain findings concerning that portion of subject property now devoted to light manufacturing purposes to-liit: \' That the subject property constitutes an island surrounded by manufactur~ ing businesses. The subject property is not reasonably usable for purely retail purposes for which :Lt is presently zoned. The surrounding properties are either zoned for or used ~)r non-conforming uses and are being used for manufacturing purposes. The foregoing circumstance is exceptional and is not applicable to other properties in the same zone. That the gr,mting of the variance requested, upon the conditions herein- after proposed will not, because of the development and use of other properties in the same vicinit:r, be inconsistent with good planning practice or the provisions . - 1 - .;t l/ 7',:,- . of the master zoning plan, or wi. th the present development of the general neighbor- hood in which said property is located, nor will the granting of the variance as hereinafter recommended adversely affect the comprehensive plan. That such vari.U1Ce is necessary for the preservation and enjoyment of sub- stantial property rights of the applicant, for the reason that the present develop- ment and use of adjacent properties are not conducive to the use of the subject property for the uses for which it is presently zoned.!1 . That such conditions then found to exist remain substantially unchanged and are generally applicable to subject property herein. SECTION 3. That for the foregoing reasons, a variance heretofore granted to applicant be extended to permit the use of the Easterly 40 feet of Lots 34, 35 and 36, Block 79, Santa Anita Tract, to be used for the business of fabricating and manufacturing purposes and the storing of materials therefor, so long as it be limited to the period of time .cfu:1'tilg tmich . Lot 3, Block 79, Santa Anita Tract, be developed, maintained and used by applicant for vehicular off-street parld.ng in . connection t-1ith the business conducted on the aforesaid Easterly 40 feet of Lots 34, 35 and 36. This conditi,on shall not preclude the owner of said property from restricting the use of said lot to the employees or customers of applicant's business. SECTION 4. The City Clerk shall certify to the adoption of this Resolution. I HEREBY CERTIFY that the foregoing Resolution was adopted at a regular meet- ing of the City Council of the City of Arcadia held on the 4th day of May, 1954, by the affirmative vote of at least three Councilmen, to-ldt: AYES: Councilmen Camphouse, Dennis, Dow, Hulse and Kennett NOES: None .
