RESOLUTION NO.2307
A RESOLUTIOI, OF THE CITY COUNCIL OF THE CITY
OF ARCADIA, CALIFORNIA, APPROVING, ACCEPTING
Al'iD ADOPTIIiG THE FINDINGS Al'iD RECOMMEiIDATIONS
OF THE PLAlUUNG COMMISSION OF SAID CITY Al'iD
DEliYI.NG PETITION FOR THE EXTENSION AND ENI.ARGE-
MENT OF A.N EXISTING VARIANCE AFFECTI.NG CERTAIN
REAL PROPERTY IN SAID CITY.

WHEREAS, 'there was filed with the City Planning Collllllission
of the City of Arcadia tbe petition of Harry B. Fox as lessee,
doing business as Equip Rent Company, requesting a zone variance
affecting tbe following described property in tbe City of Arcadia,
. to-wit:
The West 100 feet of Lot 69, Santa Anita Colony, as shown
on map recorded in Book 42, page 87, Miscellaneous Records
of Los Angeles County, except that portion in streets, be-
ing located at 82 W. Las Tunas Drive,
to permit tbe extension of the existing variance to operate an
equipment rental yard to include an additional 25 feet to the East
of the present '1ard, and to extend tbe time of the original variance
an additional five (5) years} and
WHEREAS, after due notice as required by the provisions of
. Ordinance No.760 of the City of Arcadia a public hearing was held
on the matter b1 and before said City Planning Commission on the
26th day of August 1952, and at which time all interested persons
were given an opportunity to be beard and to present evidence; and
WHEREAS, said City Planning Commission did thereupon find
and recommend as follows:
That there were four protests by owners of property in the near
vinicity of the subjeet property objecting to the granting of the
petition. That the variance affecting subject property heretofore
originally granted, and as subsequently extended, will not expire

until 1955; ths.t there is no present need for the further extension
of said variance; that the variance heretofore granted sbould not
be further extended at this time as it will have a retarding affect
upon development of unimproved adjacent properties. That tbe re-
quested extens1.on will project so far into the future as to make
the integratioll. of the business conducted on the subject and ad-
jacent propert~. difficult, if not impossible; that the requested

. variance is not necessary for the protection of any vested rishts;
that the permi ttinS of equipment heavier or larger than that nov
permitted under the existing variance vill be extremely detriment-
al to other properties in the same vicinity and zone, and is not
necessary for the preservation or enjoyment of substantial property
~iShts of the owner or lessee of the subject property, and
WHEREAS, the said City Plannins Commission has recommended
in its Resolut1,on No.89, passed, approved and adopted September 23,
1952, that the afbresaid petition be denied for the reasons there-

in fully set forth;
NOW, THEREFORE, the City Council of the City of Arcadia
does hereby find, determine and resolve as follovs:
SECTION 1. That the findinss of the said Ci ty Plannins
Commission as eet forth in their said Resolution No.89 be and each
of the same arEI hereby accepted and made the findings of this Oi ty
Council, the same as it herein asain specifically set forth in full.
SECTION 2. That the recommendation of the said City
Plannins Commission as set forth in its said Resolution No.89 be
and the same ill hereby approved in full, and that the request of
the petitioner for the extension and enlargement of an existins
variance as hereinbefore set forth be and the same is hereby denied.
SECTION 3. The City Clerk shall certify to the adoption
of this resolution.

AYES: Councilmen Dav, Hulse, Kennett and Nottingham
NOES: None
