RESOLUTION NO.23l2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING AND GRANTING A ZONE VARIANCE AFFECTING CERTAIN REAL PROPERTY IN SAID CITY TO PERMIT THE CONSTRUCTION,MAINTENANCE lU'lD OPERATION OF A BUNGALml HOTEL, SWIMMING POOL, GARAGES AND AUTOMOBILE PARKING FACILITIES THEREON. vlHEREAS, there lias filed with the City Planning Collllllission of the City of Arcadia, California, the petition of Al F. Hopp as purchaser, requesting a zone variance affecting the following described real property, to-wit: . That portion of Lot 1, Tract 949 in the City of Arcadia, County of Los Angeles, State of California, as per map recorded in book 17, page 13 of Maps, in the office of the County Recorder of said County, described as follows: Beginning at the point of intersection of the souther- ly curved line of Colorado Boulevard (formerly Orance Avonue) 80 feet in width, as described in Parcel 4 in Deed to sllid City of Arcadia, recorded in book 9396, P"ge 145 of Official Records, with the northeasterly line of Colorado Place as described in Parcel 3 in Deed to said City and recorded in book 9396, page 145 of Official Re- cords, (a radial bearing to said point of intersection bears sou~h 320 51' 49" West); thence easterly along said curved southerly line of Colorado Boulevard, along a curve concave to the northeast and having a radius of 756.78 feet, a distance of 390.04 feet to a point (a radial bear- ing to said point bears south 30 20' 9" West); thence south 00 47' 43" East 513.38 feet more or less, to the inter- section with thB northeasterly line of said Colorado PIece; thence No:::>th 30 33' 16" West along said Northeasterly line of Colorado Place 735.26 feet to the point of beginning. EXCEPTING therefrom the following: Beginning at the point of intersection of the Southerly curved line of Colorado Boulevard (formerly Orange Avenue) 80 feet in uidth, as described in Parcel 4 in Deed to said City of Arcadia recorded in book 9396, page 145 of Official Records of said County, with the Northeasterly line of Colorado Place as described in Parcel 3 in Deed to City recorded in book 9396, page 145 of Official Records (a radial bearing to said poin"t of intersection bears South 320 51' 49" West); thence easterly along said curved southerly line of said Colorado 30ulevard along a curve concave to the northeast and havin3 a radius of 756.78 feet, a distance of 290.04 feet; the::lce south 170 41' 40" "Hest 235.47 feet more or less, to a point in the northeasterly line of said Colorado Place, distant South 300 33' 16" East 385.26 feet from the inter- section of the souther11 curved line of Colorado Boulevard (formerly Orange Avenue) aforementioned; thence North 300 33' 16" West along said northeasterly line of said Colorado Place 385.26 feet to the point of beginning, to permit the seme to be used for the construction, maintenance and operation of a bungalow hotel, swimming pool, garages and automobile parking f&cilities thereon, and WHEREAS, said City Planning Commission acting in an advisory capacity to the City Council has made its findings and recommendation -1- . . . OF THE CITY Pt..rurnING COMMISSION OF THE CITY OF ARCADIA, CALIF ORIllA, RECOMMENDING THE G~JTING OF A ZONE VARIANCE AFFECTING CERTAIN REAL PROPERTY IN SAID CITY TO PERMIT THE CONSTRUCTION, MA.lroENANCE AND OPERATION OF A BUNGALO\-l HOTEL, SWlMr<IING POOL, GARAGES AIiD AUTOMOBILE " PARKING FACILITIES THEREON.:, a true copy of which is attached here- to and made a part hereof by reference the same as if herein fully set forth. NOW, THEREFORE, the City Council of the City of Arcadia . does hereby find, determine and resolve as follows: SECTION 1. That the findings of the City PlannL~B Connnission as sl3t forth in their said Resolution No.95 be and e.re hereby accepted and approved and made the findings of the City Council and that the recommendstionsof the City PlanninB Commission as set forth in their Rcsolution No.95 are hereby accepted as here- inafter augmented, and that the aforesaid petition for variance be and the same is hereby granted on the follo'''ing condi tions: (1) ':'hat no portion of said premises shall at any time . be used or perm~tted to be used for: . Gambling Bookmaking The transmission or reception by any means whatsoever of any results of horse races for any commercial purposes whatsoever. For the production, sale, distribution or dissemin- ation of tip sheets upon horse races. That the construction of all improvements authorizod by the variance hereby recommended be commenced with- in a period of six months after the effective date hereof and completed within six months after such commencement, and that no further improvements not otherwise permitted ~~der the basic zoning appli- cable to the property shall be thereafter constructed except upon renewed application for an extension of the variance recommended. That each of said conditions shall be interdependent each upon the other, and that violation of anyone or more conditions shall be cause for immediate revocation of the entire variance herewith granted. SECTION 2. The City Clerk shall certify to the adoption ~~~ (n) (n) (F') of this Resolution.
