Foto as owner, re- questing the reclassification from Zone R-3 to Zone C-2 or Zone C-3 of the follryHing described property, to-wit: Lots 6 and 7, Tract Ro.11438, as sho~m on map recorded 1~ Book 234, paBe 22 of Maps, re~ords of I.os A.l1gsles County, and being located at the Northe~st cor~er of Santa Anita Avenue end Live Oak L.v€lnue, lmEREAS, after due notice as required by law pUblic hsarings were held on the matter by and before said City Planning Commission on AUBUst 26, 1952 and September IO, 1952, at which times all i~ter- ested persons were given a full opportunity to be heard and to pre- sent evidence: ~~d WHERK~8, on the 18th day of November 1952, after due notice a public hearing was held on the matter by and before the City Council, at which time all interested persons were given a full opportunity to be heard and to present evidence; and In!&REAS. tho City Council on November 18, 1952. took this mattor under advisement and the recommendations of the City Planning Commission thereto; NffiT, THERIWORE, the City Council of the City of Arcadia does hereby find, determine and rssolve as follo\-Ts: SECTION 1. That the property immediately to the North of . subject propert:r is zoned R-l; that proper plc.nning for the pro- toction of the property and residents in 'the Braa forbids the un- qualified reclassification of subject property as Zone C-2 or Zone C-3; that tho uno..'lalificd reclassification of subject property as requested wo~ld be detriment~l to the public welfare and in- jurious to the adjacent properttes, would be contrary to the public convenience and General welfare, and is not necesDary for the pro- toction of Du~stantial ~roperty rishts of ~€ petitioner. -1- . !NDE)(ED ..z3>z.} . . . . ' classification from Zone R-3 to Zone C-2 or Zone C-3 of the property hereinbefore described shall be and the same is hereby denied. SECTION 2. That the widening and improvement of Arrow Highway Easterly of the Arcadia City limits, has made Las Tunas Drive and Live Oak Avenue, at the junction of wh1ch the subject property 1s located, one of the major East-West traffic arterials in the City of Arcadia; that Santa Anita Avenue 1s a major North-South traffic arterial and is designated as a truck route by Ordinance of the City of Arcadia; that the intersection of Las Tunas Drive. Live Oak Avenue and Santa Anita Avenue, at which subject property is located. is one of the major traffif intersections of the City of Arcadia; that commercial uses presently exist on the southeast and Southwest corners of said intersection and commercial and semi-industrial uses lawfully exist on the triangle immediately South~ast of subject pro- perty; that the Northwest corner of said property is zoned for com- mercial uses; that the subject property being on the Northeast corner of said intersection should be expanded to light commercial uses; that the grant1ng of a variance as hereinafter recommended will not be harmful or detl~imental to the properties or improvaments in the vicinity of the subject property, will not be contrary to the compre- hensive general plan and is necessary for the protection of property rights of the owner of subject property. The fact that subject pro- perty is a corner lot abutting truck poutes and major traffic arterials is exceptional and does not apply generally to the property in the same vinInity and zone. SEOTION J. That for the foregoIng reasons a zone variance is hereby granted to permit the property hereinbefore described to be used for all uses presently permitted in Zone 0-2 under Ordinance No.760 excepting only those specified in sub-seotions 3. 5. 9. 10, 13. 25, 32. 43. 51. 58, 64 and 66 of Part A of Seotion 9 of said Ordinance No.76o. provided that all buildings and structures designed, intended or used for any commercial purpose hereby authorized Shall be construe. ed and maintained in accordance with the requirements for Fire Zone 1 of the City of Arcadia. SECTION 4. The City Clerk shall certify to the adoption of .e '3 '2./ 'this Resolution. . . . - .
