RESOLUTION NO.2322 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADI!\., CAI,rFORNIA, DENYING THE PETITION FOR RECI.ASSIFICATION FROr-: ZONE R-3 TO ZONE C-2 OF CERTAIN REAL PROPERTY IN SAID CITY. . WHEREAS, there was filed with the City Planning Commission of the City of lu'cadia the petition of Holger A. and Cellia H. Valentine, as owners, requesting the reclassification from Zone R-3 to Zone C-2 of the following described property in the City of Arcadia, to-wit: . Lot 55, Tract No.l32l7, as shown on map record- ed in Book 264, Pages 26 and 27 of Maps, records of Los i\ngelos County, and being located at the Northeast corner of Second Avenue Bnd Live Oak Avenue. vrnEREAS, after due notice as required by law public hoarings were held on the matter by and before said Planning Commission on August 26, 1952 and September 10, 1952, at which times all 1nterested persons were given a full opportunity to be heard and to present evidence; and ~r.HEREAS, on the 18th day of November, 1952, after due notice . a pUblic hearing was held on the matter by ~~d before the City Council, at which time all interested persons were eiven a full opportunity to be heard and t" present evidence; and ~~REAS, the City Council on November 18, 1952, took the metter under advisement and has since considered the evidence presented and the findings and recommendations of the City Planning Commission re- la. ti va thereto; NOW, THER1WORE, the City Council of the City of !l.rcadia does hereby find, de tel'mine and resol ve e.s follows: SECTION 1. That all of the property adjacent to and on the . North side of the subject property is zoned R-l. That subject property is wall suited for and may readily be used for the purposes for whtch 1.t is presently zc.ned. That subject property is zoned R-3 and in e.ddi tion to mul tiplo family purposes subject property may la'tfully be used for bungalow courts, boardine &~d lodGins houses, offices of physiciQns, surgeons, dentists and other practitioners, privete cluba, schools end churches among other th1r-es. '-z.- ... ,. . . . subject propert~ is suitable for some of such uses is evidenced by the fact that within the same block of subject propert~ &~d on the same side of the street there is a lares group of professional offic€s, towit: the Live Oak Medical Building. Although Live Oak Avenue is one of the major East-West traffic arterials in the City of Arcadia, Second Avenue is neither a through North-South traffic arterial nor is it nearly so ~eavily travelled as Santa Anita Avenue and Baldwin AVenue. It is not a truck route as is Santa Anita hvenuG, nor is it presently plennod to become a through traffic arterial. That the use of the subject property for the majority if not all of the uses permitted in Zone C-2 would be injuriOUS and detrimental to the adjacent and surrounding properties in the general Vicinity and zone. That the subject property is a relatively small parcel and the commercial zoning thereof would permit it to be used for purposes inharmonious with and detrimental to the uses permitted on adjacent properties. That the reclassifi- cation of the subject property to Zone C-2 would be premature and . would retard or prevent the orderly development of the area. That . . the requested change of classification is not necessary for the preservation or' protection of substantial property rights of the applicante. Ttat there are no circumstances applicable to the subject property that are not equally applicable to other properties in the same Vicinity and zone especially along Live Oak Avenue. SECTI01\'" 2. That for the foregoing reasons the request of peti~rfor a change of classification from Zone R-3 to Zone C-2 shall be and the same is hereby denied. SECTIO~ 3. The City Clerk shall certify to the adoption of this Resolution.
