RESOLUTION RO.2339 A REBOLUTIOlf OF THE CITI-COURCILOF THE CITY OF ARCADIA, CALIFORNIA, DECLARING ITS Il'fl'EliTIOR TO FORM A LIGHTIRGdMAIRTENAliCEDISTRICT~ WHICK'DISTRICT IS TO PAY A PORTION OF TBK COST' AlfD' EXPlmSES OF THE MAINTENANCE AND OPERATIOH OF A STREET LIGHTING SYSTEM OH PORTIOHS OF HIGHlcAHD OAKS DRIVE, DOSHIER AVENUE, GRAHDVIEW AVENUE, WHITE OAKS DRIVE, ELKINS AVENUE AIiD ELKINS PLACE IN SAID CITY, AlfD FIXING A TIME AND PLACE FOR HEARING OBJECTIOHS TO THE FORMATIOH OF SAID DISTRICT OR TO THE lU'l'mT THEREOF. THE CITY COUNCIL OF THE CITY OF ARCADIA DOES HEREBY FIND, DETERMINE AlfD RESOLVE AS FOLLOWS: SECTION 1. That the public interest and convenience require and tbat it is tbe intention of the City Council of the Oity of Arcadia to form a Lighting Maintenance District to be known as Ligbting Maintenance District No.5, tor- the purpose of assessing said District to pay a portion of tbe cost and expenses of main- taining and operating a street ligbting system consisting ot ~t twenty-four (24) steel poles equipped witb a mast &1'11I and an en- closed type luminsire, connected with a single overhead conductor. Eacb lnm1"lltre will contain one 2500 lumen street series lamp, and . . will burn on an all-night basis. . \' ",' SECTION 2. The items of expense of maintenance and operation of the said lighting system to be furnished and to be assessed in part against t,be lands within the District (exclusive ot improve- IIlents), are electric power, repairs, replacements, labor, materials, engineering, printing and advert18ing.The .estimated amount of electric power necessary for said system for each year is Thirteen Thousand One Hundred (l3,100) Kilowatt hours and the estimated oost of said electric power tor the first year of maintenance and . operation is the sum ot Two Hundred Twenty-tour and 64/100 $224.64), and tbat the estimated cost of all otber items of maintenance and operation of flaid system for tbe first year is the sum of Eight Hundred ThirtJr-eight and 28/100 Dollars ($838.28), SECTION 3. A plat or map of said District indicating by & boundary line the extent of the lands included in the proposed distriot was approved and adopted by Resolution No.2338 of the City Council of said Cit1 of Arcadia, and is on file in the office of the Cit1 Clerk of the City of Arcadia. Reference 1s hereby made to said plat or map for further, full and complete description of said Lighting Maintenance District NO.5 and said map so on file shall govern for all details as to the extent of such district. SECTION 4. That said maintenance and operation shall be furnished for said system for a period of five 1ears from the date of the formation of said district. SECTION 5. The Cit1 Council of the Cit1 of Arcadia here- b1 orders that fUt, percent (5~) of the total maintenance and operation cost and expenses of said s1stem be paid out of the treasury of said Cit1 from the general f\U1d of said Cit1. SECTION 6. Notice 1s hereb1 given that on Tuesda1 tbe 7th . da1 of April, 1953, at the hour of 8:00 o'clock P.M., of said day, in the Council Chambers of said Cit1 Council of said City of Arcadia, in the Cit1 Hall of said City, any and all persons owning land or having any interest in landS within the district liable to be assess- ed for the expenses of said maintenance and operation of any portion thereof, IIIBY be heard and any of said persons may present an1 objections that they may have b1 protest. SECTION 7. All the proceedings for the aforesaid main- tenance and operation of said system shall be had and taken \U1der and in accordance with the prOVisions of an act of the Legislature of the State of California known and designated as the Municipal Lighting Maintenance District Act of 1927, being Division l4, Part 3 of the Streets and Highways Code of the State of California. SECTION 8. The Superintendent of Streets shall post or cause to be posted, copies of th1s Resolution headed "Notice of -2- .2. .3 -.3 '1 r - - . , ". ~ '., I..f- -.... ., Formation of L:Lghting Maintenance District" along all open st!'eets within said district liable to be assessed, in the manner and form required by law. The City Clerk shall cause this Resolution to be publish- ed twice, the first publication to be at least twenty (20) days before the date of the hearing set forth. SIDTION 9. The City Council of the City of Arcadia hereby orders that fifty percent(50%l of the total maintenance and operation cost and expenses of said system be paid out of the treasury of said City from the general fund of said City.' . Notice is hereby given that on Tuesday the 7th day of April, 1953, at the hour of 8:00 o'clock P.I.!., of said day, in the Council Chambers of said City Council of said City of Arcadia, in the City Hall of said City, any and all persons ovming land or having any interest in lands within the district llable to be assessed for the expenses of said maintenance and operation of any portion thereof, may be heard and any of said persons may present any objections that they may have by protest. SECTION 7. All the proceedings for the aforesaid maintenance and operation of said system shall be had and taken under and in accordance with the provisions of an act of the Legislatuve of the State of California known and designated as the Municipal Lighting J.laintenance District Act of 1927, being Division 14, Part 3 of the Streets and Highways Code of the State of California. S1CTION 8. The Superintendent of Streets shall post or cause to be posted, copies of this~ ..
