A RESOLUTIOIi OF THE CITY COUHCIL OF THE CITY
OF ARCADIA, CALIFORliIA, DEHYI)lG A REQUEST FOR

lative thereto. .
WHEREAS, tbere was flled witb tbe Plazming Commission of the
C1t7 of Arcadia on November 25, 1952, the verified application of
Herbert L. Herscber, M.D., as owner, for a variance affecting
Lots 1, 2 and 3 of Block 66, Santa Anita Tract to permit tbe
construction and maintenance of a covered porcb extending into
tbe required side 7ard, pursuant to wbicb after notice required
b7 law public bearing was beld b7 and before said Plazming Com-
lII1asion on the 23rd da7 of December, 1952, at wbicb time all
persons interested were given a full opportun1t7 to be heard;
no person appeared to present evidence, nor was an7 testimon7
or documenta17 evidence submitted in writing; and
WHBREAS, no final action baVing been taken on said petition
as required b7 Ordinance 110.760 of tbe City of Arcadia, the
Secretar7 of said Collllll1seion did in accordance with said Ordin-
ance 50.760 translll1t the entire file in the matter to the C1t7

Councll; and
WHBREAS, the Cit7 Council bas reviewed tbe entire tile and
bas reoei ved reports froll various Oi tJ Officials concerning the
same,

HOW, THEREFORE, the Cit7 Council ot the Cit7 of Arcadia
does bereb7 find, determine and resolve as follows:
SECTION 1. Tbat tbere is no evidence in the proceeding up-
on which the findings required for a variance under Ordinance No.
760 could be predicated; that tbe requested variance is not nec-
essar7 for the preservation of substantial property rigbts and
sbouJd be and 1s bereby denied.
SECTIOlf 2. Tbat under applicable Ordinances, an uncovered
porcb could ext..end into tbe required side yard of subject property
a distance of nix (6i) feet; that tbe porcb constructed b7 appli-
cant extends into the required side yard on17 four (4) tee,.; that
unsupported eaves ~re permitted under applicable Ordinances to

to issue a BU11,I1ing Perm! t therefor upon P&1JI18Dt ot the proper tee,

Code.

SECTION 3. The C1t1 Clerk shall certif1 to the adoption
of the forgoing Resolution.
I HEBRBY CERTIFY that the toregoing Resolution was adopted
adjourned
