A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF AHCADIA, CALIFORNIA, DECLARING ITS INTENTION TO VACATE A PORTION OF WINDSOR DRIVE AND CORNELL DRIVE, PUBLIC STREETS IN SAID CITY, AND FIKING A TIME AND PLACE FOR THE HEARING OF OBJECTIONS TO SUCH PROPOSED VACATION.' THE CITY COUNCIL OF THE CITY OF ARCADIA DOES RESOLVE AS FOLLOWS: . SECTION 1. That the pUblic interest and convenience re- quire, and the'City Council of the City of Arcadia does hereby declare its intention, to vacate the following portions of public streets in the City of Arcadia, officially named and commonly known respectively as Wi&dsor Drive and Cornell Drive, to-wit: A portion of Windsor Road a'1d Cornell Drive adjacent to Lot 15 and Lot 26, Tract No.17329. . SECTION 2. The City Council further deteI'l'il1nes that the pUblic convenience and necessity require the reservation and ex- ception to the City of Arcadia the right and easement, at any time, or from time to time, to construct, maintain, operate, repair, re- place, remove or renew sanitary sewers, water and storm drains, electric poles, wires, cross arms, guy wires and conduits, gas mains and linea, water mains and lines, and any other utility, together with all structures necessary or pertinent to any thereof, in, on, upon, over and across said portions of Windsor Drive and Cornell Drive hereinabove described and proposed to be vacated as herein declarea, and tha~ the proceedings taken hereunder are subject to OUc)1 reservotioilD and exceptions. SECTION 3. A map or plan indicating by boundary lines the location and eJctent of the p~operty included in the proposed vacation is on file in the office of the City Clerk and reference is here- by made to said map or plan for a further full and complete des- cription of all. the properties comprising the aforesaid portions of streets proJ;,osed to be vacated as hereinbefore declared. . . -1- ~~~Er 02375/ . l .' > 9 . > -3'" J.. r SECTION 4. The proceedings herein shall be pursuant to Chapter 5 of Part 3 of Division 9 of the State and Highways Code of the State of California. The City Council hereby declares its intention to convey by deed its interest in the portions of streets vacated to the owners of the lands adjacent to or fronting on such streets in such manner as it deems that equity requires as consider- ation for deedo for new streets to be opened in lieu of the portions of streets proposed to be vacated. SECTION 5. That the 16th day of June 1953, at 8:00 o'clock P.M. on said day in the Council Chambers of said City Council in the City Hall in said City of Arcadia, 240 W. Huntington Drive, Arcadia, California,is hereby fixed as the hour, day and place at which any and all persons interested in or objecting to the said proposed vacation may appear before this City Council add show cause why the aforesaid portions of Windsor ~ive and Cornell Drive shall not be vacated and ab~ldoned as herein set forth, and to present evidence relative to the proposed execution and deliver,vof deeds conveying . the City's inter'est in the portions of streets thus proposed to be . . . vacated. SECTION 6. The Superintendent of Streets shall cause to be posted notices of the passage of this Resolution and of the aforesaid hearing at the places and in the manner required bY law. SECTION 7. The City Clerk shall certify to the adoption of this Resolution and shall cause the same to be published once in the Arcadia Bulletin, a newspaper of general circulation published and circulated in the City ot Arcadia.
