RESOLUTION NO.2385
A RESOLUTION OF THE CITY CORCIL OF THE CITY
OF j\RCADIA, CALIFORNIA, EXPANDING AND EXTEND-
ING EXISTING VARIANCE AFFECTING REAL PROPERTY
IN SAID CITY FOR AN ADDITIONAL PERIOD OF FIVE
YEAJ~, UPON SPECIFIED CONDITIONS.

WHEREAS, on the 4th day of May, 1953, after hearings before
the City Planning Commission and the City Council as required by law,
the City Council of the City of Arcadia adopted Ordinance No.704
wherein and whereby a variance was granted to permit the property
hereinafter described to be used for a Real Estate Insurance Brok-

er's business; and

WHEREAS, after hearings by and before said Commission and this
City Council, the City Council of the City of Arcadia did on March
31, 1950, adopt Ordinance No.80o wherein and whereby said variance
was expanded to include business and professional offices upon con-
ditions therein specified; and
tiffEREAS, there was filed with said Commission on ~mrch 24,
1953, the petition of Ben and Sophia Roitstein as owners, for the
further extension of the variance hereinbefore granted as aforesaid
for an additional period of Five (5) years, and for the addition
to the existing structures of an additional structure approximately
10' x 10' in size; and
WHEREAS, after notice required by Ordinance No.76o of the
City of Arcadia, a public hearing on said application was held by
and before said Commission on the 14th day of April, 1953, at which
time all interested persons were given a full o.pportunity to be
heard and to present evidence, at the conclusion of which said Plan-
ning Comm~ssion, acting in an advisory capacity to the City Council,
made its findings and recommendations under its certain Resolution
entitled: "A Resolution of the City Planning Commission of the City
of Arcadia, California, Recommending the Extension of an Existing
Variance under Specified Conditions.", adopted May 12, 1953, a true
copy of which is attached hereto and made a part hereof by refer-
ence the same as if fully set forth.
NOW THEREFORE, the City Council of the City of Arcadia does
. hereby find, determine and resolve as follows:

SECTION 1. That there were no protests to the granting of
said petition.
SECTION 2. That there has been no substantial change in the
conditions existing at the time of the granting of the previous
variances.
SECTION 3. That the granting of the requested extension for
the period of time hereinafter provided will not be inconsistent
with good planning practice or the provisions of the Master Zoning
plan, nor with the present development of the neighborhood in which'

subject property is located, nor will the granting of the requested
extension as hereinafter provided, adversely affect the general com-
prehensive plan. That the requested extension is necessary for the
preservation and enjoyment of substantial property rights of appli-
cants.
SECTION 4. That the variance heretofore granted by Ordinance
No.704 as amendbd by Ordinance No.800, be and the same is hereby ex-
tended for a period of Five (5) years from and after the date hereof
and the same variance be further expanded to permit the addition to
existing structtwes of an additional structure not to exceed 10 feet
by 10 feet in si.ze. That the property affected by the variance
hereby granted is described as follows:
The North or.e hundred fift~ (150) feet of the East
Ninety and fifty-four one hundredths (90.54) feet
of Lot six (6), Tract No.4090, as shown on Mapre-
corded in Bool: 43, Page L~7 of Haps, in the office
of the County Recorder of sa~d County;
SECTION 5. The City Clerk shall certify to the adoption of
this ,Resolut~on.

I HEREBY CERTIFY that the foregoing Resolutio~ was adopted at
a regular meeting of the City Council held on the'2ild day of June,
1953, vy the affirmative vote of at least three Councilmen, to-wit:
AYES: Councilmen Dow, Kennett and Nottingham
NOES: None
ABSENT: Councilmen Hulse and Schmocker
