RESOLUTION NO.2387
A RESOLUTION OP THE CITY COUNCIL OP THE CITY
OP ARCADIA, CALIFORNIA, APPROVING AND GRANTING
A ZONE VARIANCE AFPECTING CERTAIN REAL PROPERTY
IN SAID CITY TO PERMIT THE CONSTRUCTION, MAINTEN-
ANCE AND OPERATION OF MULTIPLE FAMILY DWELLING
UNITS THEREON.

WHEREAS, there was filed with the City Planning Co~ission
of the City of Arcadia the petition of Fred N. Howser, as owner,
real
requesting a zone variance affecting the following described/property
in said city, to-wit:
Parts of Lots 7, 8, 9 and 10, Tract No.13467, as
shown on map record~ in Book 272, pages 14 and
15 of Maps, and part of Lot 1, Tract NO.949, as
shown on map recorded in Book 17, Page 13 of Maps,
records of Los Angeles County, described as follows:
Beginning at the most southerly corner of said lot
10; said point being in the curved nOBtherlr, line
of Colorado Boulevard; thence North 8 53'24' East
240.18 feet; thence North 60023'32" East 26.29 feet;
thence North 53039'00" East 158.74 feet, thence North
37038'35" East 129.68 feet; thence South 44045'40"
East 114.39 feet; thence South 16031'07" West 55.29
feet; thence South 9032'45" West 235.10 feet; thence
South 1955'55" West 165.05 feet to the northerly line
of Colorado S.ulevard; thence westerly thereon 301.82
feet to the point of beginning, being a parcel of land
containing 2.628 acres located on the north side of
Colorado Boulevard, near its intersection with Colorado
Place,

to permit the sam(! to be used for the construction, maintenance and
operation thereon of multiple family dwelling units; and
WHEREAS, after due notice as required by Ordinance No.760 of
the City of Arcadia, a public hearing was duly held on the matter by
and before said C1.ty Planning Commisaion on the 28th day of April,
1953, at which time all interested persons were given a full oppor-
tunity to be heard and to present evidence; and
liHEREAS. said City Planning Commission acting in an advisory
capacity to the City Council has made its findings and recommcndaticr.s,
after public hearing duly held and noticed by and under its certain
Resolution No.l08 entitled: "A Resolution of the City Planning Com-
mission of the City of Arcadia, Caiifornia, recommending the Granting
of a Zone Variance Affecting Certain Real Property in said City to
Permit the Construction, Maintena~ce and Operation of Multiple Family
Dwelling Units thereon.", a true copy of which is attached hereto and

made a part hereof by reference the same as if herein fully set forth;
and
WHEREAS, an appeal from the decision and recommendation
of said Planning Commission in the matter was heretofore filed by
William Peter Silge and others, pursuant to which after due notice,
public hearing in the matter of said variance application and the
said appeal was held by and before this City Council on June 2, 1953,
at which time all interested persons were given full opportunity to
be heard and to present evidence; and
WHEREAS, the City Council has fully considered the matter
and reviewed the files thereon and the evidence heretofore presented;
NOW, THEREFORE, the City Council of theCity of Arcadia
does hereby find" determine and resolve as follows:
SECTION 1. That subject property abuts Colorado Boulevard,
a heavily travelE!d thoroughfare; that adjacent properties may law-
fully be used foz' or are develop8d to the following uses among others:
on the North for multiple family residential bungalows, to the West
for a restaurant and cocktail lounge, te the South for a drive-in
restaurant, a motel and multiple fl!Jllily dwellings, that a portion
of subject proper'ty already has a variance for off-street parking
in connection with the restaurant and cocktail lounge presently per-
missible on adjacent property to the West; that subject property is
of uneven contour and is surrounded on the West and Northwest by a
high elevation, the remainder being in part many feet below the level
of the abutting stre~t. That subject property is not ideally situat-
ed fo~ single family development, but .is id~ally situated and suited
for the type of use herein requested. That the foregOing circumstances
are exceptional and do not apply generally to all properties in the
same vicinity and zone.
SECTION 2. That the granting of the variance as herein
after recommended will not be injurious or detrimental to other pro-
perties or improvements in the same vicinity and zone; that the grant-
ing of the variance hereinafter recommended is reasonably necessary for
the preservation and enjoyment of substantial property rights of the

. applicant; that the granting of the variance hereinafter recommended
will not be materially detrimental to nor will it adversely affect

the comprehensive general plan.
SECTION 3. That a variance be and the same is hereby grant-
ed to permit the property hereinbefore described to be used for the
construction. maintenance and operation thereon of multiple family
dwellings not to exceed two stories in height nor more than fifty-
five dwelling units in number, together with access, vehicle parking
. and accessory bWJldings incidental thereto.
SECTION 4. The City Clerk shall certify to the adoption
of this Resolution.
I HEREBY CERTIFY that the foregoing Resolution was adopted
at a regular meeting of theCity Council held on the 16th day of June,
1953, by the affirmative vote of at least three Oouncilmen, to-wit:
AYES: Councilmen Dew, Hulse, Kennett and Schmocker
NOES: None
ABSENT: Councilman Nottingham
