HomeMy WebLinkAbout2388 , RESOLUTION NO.2388 . ~ '" .( .4 ) A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF ARCADIA, CALIFORNIA, APPROVING AND GRANTING A ZONE VARIANCE AFFECTING CERTAIN REAL PROPERTY IN SAID CITY TO PERMIT THE CONSTRUCTION, MAINTENANCE AND OPERATION WHEREON OF ONE STORY APARTMENT HOUSES UPON SPECIFIED CONDITIONS. WHEREAS, on April 28, 1953, the City Planllint Commission of the City of Arcadia did on its own motion pursuant to its Resolution No.106, institute proceedings for the consideration of a zone variance to permit the cc'nstruction and maintenance of single story, multiple family dwellings on the tollowing described real property in said City: Tholl! portions ,of Lots 5 and 6, Tract No .949 as shown on map recorded in Book 17, Page 13 of Maps, Records of Los Angeles County, included within the following described exterior boundary line; Beginning at the southeast corner of Lot l29, Tract No.12l04, as shown on map recorded in Book 226, Pages 37, 38 and 39 of Maps, records of SLid County; thence South 87001'35" East 220 feet to the West line of Baldwin Avenue; thence Northerly along the west line ot Baldwin Avenue to the North line ot said Lot 5, Tract No.949i thence West thereon to the Northeast corner of Lot 5, Tract No.l4460, as shown on map re- corded 1n Book 318, Page 44 of Maps, Records of said County; thence Southerly along the Easterly lines of said Tract No.14460, Tract No.12786, as shown on map recorded in Book 263, Pages 3 and 4 ot Maps Records of said County, and aforesaid Tract No.12l04 to the point of beginning, (being all that property located on the West side of Baldwin Avenue beginning apprOXi- mately 220 feet North of Huntington Drive and extend- ing to the South line of the Los Angeles State and County Arboretum.), and WHEREAS, after notice required by Ordinance NO.760 of said City a public hearing was held by and before said City Planning Commission on the 12th day of May, 1953, at which time all interested persons were given a full opportunity to be heard and to present evidence; and WHEREAS, said City Planning Commission, acting in an advisory capacity to the City Council, has made its findings and recommen- dations relative thereto, under its certain Resolution No.109, en- titled: "A Resolution of the City Planning Commission of' the City of Arcadia, California, Recommending the Granting of a Zone Variance Affecting Certain Real Property in Said City, to Permit the Con- struction and Maintenance thereon of one story Apartment Houses, . Upon Specified Conditions.", a true copy of which is attached hereto . . and made a part hereof by reference the same as herein again fully -1- '>l91'.1t€9 .z -381> . . . . . . . . , J set forth; NOW, THEREFORE, the City Council of the City o~ Arcadia does find, determine and resolve as follows: SECTION 1. That there were no p~otests, written or oral, to the granting of the variance as proposed, upon the conditions here- inafter recommended. That all of the above described property is equally affected by conditions warranting the granting of the pro- posed variance. SECTION 2. That when SUbject property was zoned R-l, Baldwin Avenue had nOt been extended as a through street North from Huntington Drive; that Baldwin Avenue is now a through arterial from Huntington Drive to Colorado Blvd.; that the property in question faces and is across the street from the property of the Los Angeles Turf Club, comprising appro.ltimately four hundred acres dedicated to horse racing and other recreational and entertaining events, and to the parking ot motor vehicles in connection with such uses; that in the near vicinity are horse stables owned by or used in conjunction with the activities of the Los Angeles Turf Club. SECTION 3. That the construction of multiple-story apartments throughout the entire area would materially decrease the value of pro- perty abutting on the rear, particularly but not necessarily limited to the lessening of the privacy of the owners of said property, and a diminuation, 1t 110t total loss, of the v1ew presently afforded said owners from their respective pDoperties. SECTION 4. That the granting of the variance as hereinafter provided will no1; be inconsistent with good planning practice or the provisions of the Master Zoning Plan, or with the present development of the neighborhood in which subject property is located, nor will the granting of such variance adversely affect the general comprehen- sive plan. SECTION 5. That such variance as hereinafter granted, is reasonably necessary for the preservation and enjoyment of substantial pboperty rights of the applicants, for the reason that the present development and use of adjacent properties and the development of Baldwin Avenue as a through traffic arterial are not cond~cive to the -2- .l~J?'" , . , J . use of subject property for the uses for which 1t 1s presently zoned. SECTION 6. That a var1ance be and the same 1s hereby granted to permit the property hereinbefore described to be used for the construction and maintenance thereon of apartment houses thereon, upon the following express and continuing conditions: (a) That no apartment house thereon constructed shall exceed one story in height. (b) That no apartment house thereon constructed shall J exceed a max~mum of eighteen (18) feet in height above final grade. . (c) That the front, side and rear yards of each apart- ment house shall not be less than required by Section 6 of Ordinance No.760 of the City of Arcadia. (d) That each of the foregoing conditions shall be con- tinuing and inter-dependent each upon the other and the violation of anyone cr ~)re conditions herein provided shall constitute grounds for the immediate rescission and cancellation ot the vanance hereby granted as to the provisions with reference to which such breach occurs. SEcnON 7. The City Clerk shall certify to the adoption of this Resolution.
