RESOLUTION NO. 2398
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
ARCADIA SETTING A HEARING FOR THE PURPOSE OF
DETERMINING WHETHER OR NOT.THE PUBLIC CONVENIENCE
AND NECESSITY REQUIRE THE IMPROVEMENT OF LA
CADENA AVENUE AND OTHER STREETS, ALL WITHIN THE
CITY OF ARCADIA.

IY.KEREAS, Section 17 of Article XIII of the Constitution of
the State of California provides that the debt limitation and majority
protest provisions of said section shall not apply if, after the giving
of such reasonable notice by publication and posting and the holding
of such public hearing as the City Council of the City of Arcadia shall
have prescribed, said council by no less than a four-fifths vote of all
members. thereof, finds and determines that the public convenience and
necessity require the improvement proposed to be made; and
.WHEREAS, Section 2804 of the Streets and Highways Code of
the State of California provides that the "Special Assessment Investi-
. gation, Limitation and Majority Protest Act of 1931" shall not apply
to any proceeding otherwise subject thereto when said improvement
proceeding is by a charter city and said city has complied with the
provisions of Section 17 of Article XIII of the Constitution of the
State of California; and
WHEREAS, the City of Arcadia is a charter city of the State
of California;
NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF ARCADIA DOES
RESOL VE AS FOLLO\'lS:

SECTION 1. That said City Council proposes to initiate
proceedings for the improvement of La Cadena Avenue between Fairview
Avenue and Huntington Boulevard, St. Joseph Street between First and
Second Avenues, Third Avenue between Huntington Boulevard and the north
line of Tract 6860, Lucile Street between First Avenue and Santa Anita
Avenue, Walnut Avenue between Baldwin Avenue and Station 12~00, and
Walnut Avenue between Station 12~OO and Holly Avenue, all within the

City of Arcadia, by the preparing of subgrade and grading necessary
for the construction of concrete curbs and gutters and appurtenant
work thereto. The nature, location, and extent of the proposed
improvement and the district to be assessed for the cost and expense
thereof as shown respectively on the plan and profile Job No. 204,
adopted by Resolution No. 2396 , on July 7, 1953, and assessment
district map No. W-64, adopted by said City Council by Resolution No.
2397 , on July 7, 1953, and on file in the Office of the City
Engineer and the Office of the City Clerk of said city and in accord-
ance with Specification entitled "Specifications and Contract Docu-
ments for Improvement of La Cadena Avenue and Other Streets;~ which
said specification duly was adopted by said City Council by Resolution
No. 2396, on the 7th day of July, 1953, which said plan and profile,
assessment district map and specification now are on file in the Office
of the City Engineer and of the City Clerk of said city, to which said
plan and prOfile, assessment district map and specifications, reference
is made for all particulars relative thereto.
SECTION 2. That the total estimated cost of the proposed
improvement is $ 20,462.43.
SECTION 3. That the said improvement shall be conducted
under the Improvement Act of 1911, which is Division 7 of the Streets
and Highways Code of the State of California.
SECTION 4. That notice hereby is given that on Tuesday,
the 21st day of July, 1953, at 8:00 o'clock p.m. in the Council
Chamber located in the City Hall of said City, there shall be a public
hearing before said City Council for the purpose of determining whether
the public convenience and necessity require the above described
improvement.
SECTION 5. That the City Clerk shall give notice of the
hearing by posting a copy of this resolution in the manner prescribed
by Section 5065 of the Streets and Highways Code and by publication

as hereinafter provided. Any person in~erested may make protest
against the proposed improvement in writing filed with the City Clerk
at any time not later than the hour set for the hearing in the manner
provided by Section 5220 of the Streets and Highways Code.
SECTION 6. That the City Clerk hereby is directed to publish
this Resolution in the Arcadia Tribune on two successive dates, the
first publication to be made not less than ten (10) days prior to the
date of the above public hearing.
SECTION 7. The City Clerk shall certify to the adoption of
this resolution and thenceforth and thereafter the same shall be in
full force and effect.

I hereby certify that the foregoing resolution was duly
adopted by an affirmative vote of four-fifths of the City Council of
the City of Arcadia at a regular meeting thereof held on the 7th
day of July , 1953, by the following vote of the Council:
